AN ACT CONCERNING CUSTODIAL INTERFERENCE IN THE FIRST DEGREE.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

That section 53a-97 of the general statutes be amended to provide that a person is guilty of custodial interference in the first degree when a parent knows or has reason to know there is no legal right to interfere with the custody rights of the other parent and (1) after the entry of a court order determining custodial rights, takes, entices or detains any child from the other parent denying that parent physical custody of the child, (2) intentionally fails or refuses to return or impedes the return of a child to the lawful custodian, including that of another person or an institution, or (3) intentionally fosters unreasonable and unwarranted fear, disrespect or hostility by the child toward the other parent so as to reject the other parent.

Statement of Purpose: 

To expand upon the type of conduct that constitutes criminal custodial interference in the first degree.
