AN ACT CONCERNING THE RECOGNITION OF STROKE CENTERS AND STROKE-READY HOSPITALS.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (NEW) (Effective October 1, 2017) (a) A hospital may apply to the Department of Public Health to be designated as a comprehensive stroke center, a primary stroke center or an acute stroke-ready hospital.

(b) The Department of Public Health shall approve an application made under subsection (a) of this section if the hospital has been certified as a comprehensive stroke center, a primary stroke center or an acute stroke-ready hospital by the American Heart Association, the Joint Commission or any other nationally recognized certifying organization approved by the department. The hospital's designation as a comprehensive stroke center, a primary stroke center or an acute stroke-ready hospital shall continue for as long as the hospital remains certified as such.

(c) The department may remove a hospital's designation as a comprehensive stroke center, a primary stroke center or an acute stroke-ready hospital if the hospital requests such removal or if the department determines that the hospital's certification as such has been suspended or revoked. A decision by the department to remove a hospital's designation under this subsection shall not be subject to judicial review. The department shall report to the certifying organization any complaint it receives related to the certification of a hospital as a comprehensive stroke center, a primary stroke center or an acute stroke-ready hospital. The department shall provide the complainant with the name and contact information of the certifying organization if the complainant seeks to pursue a complaint with such organization.

(d) No hospital shall hold itself out to the public as a stroke center or stroke-ready hospital unless the hospital is designated as a comprehensive stroke center, a primary stroke center or an acute stroke-ready hospital by the Department of Public Health under subsection (b) of this section.
