AN ACT CONCERNING THE STATUTE OF LIMITATIONS FOR MEDICAL MALPRACTICE CLAIMS ARISING FROM SURGICAL MATERIALS THAT ARE NOT PROPERLY EXTRACTED AT THE TIME OF SURGERY.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

That section 52-584 of the general statutes be amended to extend the statute of limitations for medical malpractice claims arising from lost or hidden surgical materials that are not extracted at the time of surgery to two years from the date of discovery of the presence of such materials.

Statement of Purpose: 

To extend the right of victims to make a claim when surgical materials are not extracted at the time of surgery.
