AN ACT CONCERNING THE APPOINTMENT OF A FIRE MARSHAL AND POLICE OFFICERS AT THE CONNECTICUT AIRPORT AUTHORITY.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. Section 29-291 of the general statutes is repealed and the following is substituted in lieu thereof (Effective from passage):

For the purposes of this part and any other statute related to fire prevention and safety, the Commissioner of Administrative Services shall appoint a person to serve as the State Fire Marshal. The commissioner may delegate such powers as the commissioner deems expedient for the proper administration of this part and any other statute related to fire prevention and safety to any employee of (1) the Department of Administrative Services, [and] (2) The University of Connecticut at Storrs Division of Public Safety, provided the commissioner and the president of The University of Connecticut enter into a memorandum of understanding concerning such delegation of powers in accordance with section 10a-109ff, and (3) the Connecticut Airport Authority upon any premises, road or land under the control of the authority, provided the commissioner and the executive director of the authority enter into a memorandum of understanding concerning such delegation of powers. 

Sec. 2. Section 29-19 of the general statutes is repealed and the following is substituted in lieu thereof (Effective from passage):

(a) The Commissioner of Emergency Services and Public Protection may, in the commissioner's discretion, upon the application of any electric distribution, gas, telephone or water company owning, leasing, maintaining, managing or controlling any property, plant or equipment in this state, commission [, during his pleasure,] one or more persons designated by such company who, having been sworn, may act at the expense of such company as [policemen] police officers upon the premises used or occupied by such company in its business, or upon any highway adjacent to such premises, for the proper protection of such plant or property, and each [policeman] police officer so appointed may arrest and take before some proper authority any person in [his] the police officer's precinct for any offense committed therein. [Said] The commissioner may exercise such supervision and direction over any [policeman] police officer appointed as herein provided as [he] the commissioner deems necessary. When any such commission is issued or revoked, [said] the commissioner shall notify the clerk of the superior court for each judicial district in which it is intended that such [policeman] police officer shall act.

(b) [Said] The commissioner may, in the commissioner's discretion, upon application of any railroad, express company or steamboat company, engaged in the business of transportation in this state, or upon the application of any corporation owning or having control of the roads in any private residence park, or upon the application of the Connecticut Airport Authority, commission [, during his pleasure,] one or more persons designated by such company, [or by such] corporation or authority, who, having been sworn, may act, at the expense of such company, [or] corporation or authority, as [policemen] police officers upon the premises used by such company or authority in its business, or upon its cars, [or] vessels or airplanes, or upon the roads and land owned by or under the control of such corporation or authority, and each [policeman] police officer so appointed may arrest and take before some proper authority any person in [his] the police officer's precinct for any offense committed therein. When any such commission is issued or revoked, [said] the commissioner shall notify the clerk of the superior court for each judicial district in which it is intended that such [policeman] police officer shall act. Each such [policeman] police officer shall, when on duty, wear in plain view a shield bearing the words "railroad police", "steamboat police", "express company police" or "special police", as the case may be, and the name of the company, corporation or authority for which [he] the police officer is commissioned.

Statement of Purpose: 

To allow: (1) The Commissioner of Administrative Services to designate a fire marshal for the Connecticut Airport Authority; and (2) the Commissioner of Emergency Services and Public Protection to designate police officers for the Connecticut Airport Authority.
