LCO No. 4329 1 of 3 General Assembly Committee Bill No. 6091 January Session, 2019 LCO No. 4329 Referred to Committee on INSURANCE AND REAL ESTATE Introduced by: (INS) AN ACT REQUIRING THE INSURANCE COMMISSION ER TO OFFER ENGLISH AND SPANISH LANGUAGE VERSIONS OF EXAMINATIONS ADMINISTERED TO CERT AIN LICENSEES IN THIS STATE. Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. Subsection (a) of section 38a-702d of the general statutes is 1 repealed and the following is substituted in lieu thereof (Effective 2 October 1, 2019): 3 (a) A resident individual applying for an insurance producer license 4 shall pass a written examination unless exempt under section 38a-5 702h. The examination shall (1) be given in English or Spanish at the 6 option of the individual, and (2) test the knowledge of the individual 7 concerning the lines of authority for which application is made, the 8 duties and responsibilities of an insurance producer and the insurance 9 laws and regulations of this state, except that no additional course or 10 examination shall be required for the line of variable life and variable 11 annuity products. Examinations required by this section shall be 12 developed and conducted under rules prescribed by the commissioner, 13 or regulations which the commissioner may adopt pursuant to section 14 38a-702p. 15 Committee Bill No. 6091 LCO No. 4329 2 of 3 Sec. 2. Subsection (c) of section 38a-769 of the general statutes is 16 repealed and the following is substituted in lieu thereof (Effective 17 October 1, 2019): 18 (c) Each applicant for a license shall furnish satisfactory evidence to 19 the commissioner that the applicant is a person of good moral 20 character and that the applicant is financially responsible. In order to 21 determine the trustworthiness and competency of an applicant the 22 commissioner shall subject the applicant to personal written 23 examination as to the applicant's competency to act as a licensee for 24 each line of insurance for which the applicant desires to be licensed. 25 The commissioner may, at the commissioner's discretion, designate an 26 independent testing service to prepare and administer such 27 examination, provided any examination fees charged by such service 28 shall be paid by the applicant. The commissioner shall collect the 29 appropriate examination fee as specified in section 38a-11, which shall 30 entitle the applicant to take the examination for the license desired, 31 except that when a testing service is used, the testing service shall pay 32 such fee to the commissioner for each examination taken by an 33 applicant. In either case, each such examination shall be (1) as the 34 commissioner prescribes, (2) given in English or Spanish at the option 35 of the applicant, and [shall be] (3) of sufficient scope to test the 36 applicant's knowledge of insurance, the duties and responsibilities of a 37 licensee and the laws of this state applicable to insurance. The 38 commissioner may require a waiting period not exceeding six months, 39 before reexamining any applicant who has failed to pass any such 40 examination. 41 This act shall take effect as follows and shall amend the following sections: Section 1 October 1, 2019 38a-702d(a) Sec. 2 October 1, 2019 38a-769(c) Committee Bill No. 6091 LCO No. 4329 3 of 3 Statement of Purpose: To require the Insurance Commissioner to offer English and Spanish language versions of examinations administered to certain applicants for licenses from the commissioner.
