AN ACT CONCERNING THE COURT'S AUTHORITY TO IMPOSE SANCTIONS AGAINST A PARTY IN A FORECLOSURE PROCEEDING. Be it enacted by the Senate and House of Representatives in General Assembly convened: That chapter 846 of the general statutes be amended to permit a 1 court to withhold interest payable to a party in a foreclosure 2 proceeding when the party engages in intentional or a pattern of 3 conduct that demonstrates a lack of good faith in dealing with the 4 opposing party or the court; such conduct includes, but is not limited 5 to, refusing to participate in the foreclosure mediation program. 6 Statement of Purpose: To incentivize good-faith dealings by the parties to a foreclosure proceeding.
