AN ACT CONCERNING LAND USE APPEALS. Be it enacted by the Senate and House of Representatives in General Assembly convened: That subsection (n) of section 8-8 of the general statutes, which 1 requires that a court hearing be held when a party seeks to withdraw a 2 land use appeal or when the parties settle a land use appeal, be 3 amended to provide that no hearing shall be required when: (1) An 4 appeal is settled during the pendency of the appeal, and (2) the 5 plaintiff seeks to withdraw an appeal, provided if the defendant 6 objects to the withdrawal of an appeal, the court shall conduct a 7 hearing on whether to permit withdrawal of the appeal. 8 Statement of Purpose: To streamline the process involving withdrawal or settlement of a land use appeal.
