LCO No. 5267 1 of 2 General Assembly Committee Bill No. 6471 January Session, 2019 LCO No. 5267 Referred to Committee on GOVERNMENT ADMINISTRATION AND ELECTIONS Introduced by: (GAE) AN ACT CONCERNING PRIMARIES FOR MUNICIPAL ELECTIONS HELD IN NOVEMBER. Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. Section 9-423 of the general statutes is repealed and the 1 following is substituted in lieu thereof (Effective from passage): 2 (a) The primaries of all parties for nomination to an office to be 3 voted upon at a state election, or a municipal election held in 4 November, shall be held on the second Tuesday in August in the year 5 in which such [state] election is held. 6 (b) The primaries of all parties for nomination to an office to be 7 voted upon at a municipal election held in May shall be held on the 8 fifty-sixth day preceding the day of [the] such election. 9 Sec. 2. Section 9-376 of the general statutes is repealed and the 10 following is substituted in lieu thereof (Effective from passage): 11 (a) [(1)] If the day fixed for any primary falls on [a Sunday or] a 12 legal holiday or on a day on which the tenets of a religion forbid 13 Committee Bill No. 6471 LCO No. 5267 2 of 2 secular activity, the primary shall be held on the next succeeding day 14 other than [a Sunday or] a legal or such religious holiday. [(2) If the 15 day fixed for any primary falls on the Tuesday immediately following 16 Labor Day, the primary shall be held on the next succeeding Tuesday.] 17 (b) If a primary is held on a day prescribed by [subdivision (1) of] 18 subsection (a) of this section, the day of the primary shall be 19 considered to be the day on which such primary would have been held 20 except for [subdivision (1) of] said subsection, for all other purposes 21 including the calculation of any period of time having reference to 22 such primary, except that the calculation of any deadline relating to a 23 person becoming eligible to vote in such primary shall be made from 24 the day on which the primary is actually held. 25 This act shall take effect as follows and shall amend the following sections: Section 1 from passage 9-423 Sec. 2 from passage 9-376 Statement of Purpose: To move, for any town that holds its municipal election in November, the primary day from September to August so as not to interfere with any school session.
