AN ACT CONCERNING SE RVICE ANIMALS.
Be it enacted by the Senate and House of Representatives in General
Assembly convened:
Section 1. (NEW) (Effective October 1, 2019) (a) No individual may 1
knowingly represent, whether expressly or impliedly, that a dog is a 2
service animal or being trained as a service animal, for the purpose of 3
obtaining any rights or privileges afforded to an individual with a 4
disability, unless such dog is a service animal or is being trained to be a 5
service animal. For purposes of this subsection "service animal" means 6
service animal and "individual with a disability" means individual 7
with a disability, both as defined by 28 CFR 35.104, as amended from 8
time to time. 9
(b) Any person who violates any provision of subsection (a) of this 10
section shall be fined not more than one hundred fifty dollars. 11
Sec. 2. Subsection (b) of section 51-164n of the general statutes is 12
repealed and the following is substituted in lieu thereof (Effective 13
October 1, 2019): 14

(b) Notwithstanding any provision of the general statutes, any 15
person who is alleged to have committed (1) a violation under the 16
provisions of section 1 of this act, section 1-9, 1-10, 1-11, 4b-13, 7-13, 7-17
14, 7-35, 7-41, 7-83, 7-283, 7-325, 7-393, 8-12, 8-25, 8-27, 9-63, 9-322, 9-18

bylaw of any town, city or borough, except violations of building codes 88
and the health code, for which the penalty exceeds ninety dollars but 89
does not exceed two hundred fifty dollars, unless such town, city or 90
borough has established a payment and hearing procedure for such 91
violation pursuant to section 7-152c, shall follow the procedures set 92
forth in this section. 93
This act shall take effect as follows and shall amend the following
sections:

Statement of Purpose:
To establish an infraction for misrepresentation of a pet dog as a
service dog.
