AN ACT CONCERNING TH E AWARD OF DOUBLE OR TREBLE 
DAMAGES TO AN INJURE D PARTY IN A CIVIL ACTION RESULTING 
FROM CERTAIN TRAFFIC VIOLATIONS. 
Be it enacted by the Senate and House of Representatives in General 
Assembly convened: 
 
Section 1. Section 14-295 of the general statutes is repealed and the 1 
following is substituted in lieu thereof (Effective from passage and 2 
applicable to any civil action pending on or filed on or after the effective date 3 
of this act): 4 
In any civil action to recover damages resulting from personal 5 
injury, wrongful death or damage to property, the trier of fact may 6 
award double or treble damages if the injured party has specifically 7 
pleaded that another party has deliberately or with reckless disregard 8 
operated a motor vehicle in violation of section 14-218a, 14-219, 14-222, 9 
14-227a or 14-227m, subdivision (1) or (2) of subsection (a) of section 10 
14-227n or section 14-230, 14-234, 14-237, 14-239, [or] 14-240a or 14-11 
296aa, and that such violation was a substantial factor in causing such 12 
injury, death or damage to property. The owner of a rental or leased 13 
motor vehicle shall not be responsible for such damages unless the 14  Raised Bill No.  7126

damages arose from such owner's operation of the motor vehicle. 15 
This act shall take effect as follows and shall amend the following 
sections:

Statement of Purpose:   
To permit an injured party to recover double or treble damages in civil 
actions involving a person who operates a motor vehicle while using a 
hand-held mobile device or other mobile electronic device in violation 
of section 14-296aa of the general statutes.
