LCO No. 4636 1 of 2 General Assembly Raised Bill No. 7165 January Session, 2019 LCO No. 4636 Referred to Committee on HUMAN SERVICES Introduced by: (HS) AN ACT CONCERNING ME DICAID COVERAGE FOR DONOR B REAST MILK. Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. (NEW) (Effective July 1, 2019) (a) The Commissioner of 1 Social Services shall provide Medicaid reimbursement for pasteurized 2 donor breast milk, provided (1) a health care professional licensed 3 pursuant to chapter 370 of the general statutes signs a medical order 4 that the donor breast milk is medically necessary for an infant in 5 accordance with section 17b-259b of the general statutes, (2) the donor 6 breast milk is provided on an inpatient basis at a hospital, (3) (A) the 7 infant who receives the donor breast milk is medically or physically 8 unable to receive maternal breast milk or participate in breast feeding, 9 or (B) the infant's mother is medically or physically unable to produce 10 maternal breast milk in sufficient quantities, or is unable to participate 11 in breast feeding despite optimal lactation support, and (4) the donor 12 breast milk is supplied by a breast milk bank accredited by the Human 13 Milk Banking Association of North America. The commissioner may 14 seek any necessary federal approval to implement the provisions of 15 this section. 16 Raised Bill No. 7165 LCO No. 4636 2 of 2 (b) The commissioner may adopt regulations to implement the 17 provisions of this section, including, but not limited to, establishing 18 which infant health conditions make the provision of donor breast 19 milk medically necessary. The commissioner may adopt a policy or 20 procedure to implement the provisions of this section while in the 21 process of adopting regulations provided such policy or procedure is 22 posted on the Internet web site of the Department of Social Services 23 and on the eRegulations System prior to adoption of the policy. 24 This act shall take effect as follows and shall amend the following sections: Section 1 July 1, 2019 New section Statement of Purpose: To provide Medicaid reimbursement for donor breast milk deemed medically necessary.
