LCO No. 4277 1 of 3 General Assembly Raised Bill No. 7172 January Session, 2019 LCO No. 4277 Referred to Committee on INSURANCE AND REAL ESTATE Introduced by: (INS) AN ACT CONCERNING CO NTINUING EDUCATION CREDITS FO R INSURANCE PRODUCERS. Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. Section 38a-782a of the general statutes is repealed and 1 the following is substituted in lieu thereof (Effective July 1, 2019): 2 The commissioner may adopt regulations in accordance with 3 chapter 54 [relating to the establishment of] to establish continuing 4 education requirements for persons licensed as insurance producers, 5 provided: [the] 6 (1) The commissioner shall suspend such requirements for any 7 person who is a public official during the period such person serves as 8 a public official, if the person is prohibited from selling insurance 9 during that period. As used in this [section] subdivision, "public 10 official" means any state-wide elected officer, any member or member-11 elect of the General Assembly, or a senator or representative in 12 Congress. 13 (2) If any such regulations require that a person licensed as an 14 Raised Bill No. 7172 LCO No. 4277 2 of 3 insurance producer earn six or more hours of continuing education 15 credit during any two-year period, the commissioner shall grant at 16 least six hours of continuing education credit to such person if such 17 person is an active member of a state-wide professional insurance 18 producer association during such period, provided the association 19 provides the commissioner or the commissioner's designee such 20 association's active membership information for such two-year period. 21 As used in this subdivision: 22 (A) "State-wide professional insurance producer association" means 23 an association that (i) has existed for ten or more years, (ii) derives its 24 membership from persons licensed as insurance producers in this 25 state, and (iii) is dedicated to promoting the integrity, trustworthiness, 26 professionalism and business interests of its members through 27 education, advocacy, social interaction and the development of sound 28 business practices; and 29 (B) "Active member" means a person licensed as an insurance 30 producer in this state who certifies to the commissioner, for the 31 applicable two-year period, that such person (i) was a member in good 32 standing of a state-wide professional insurance producer association, 33 (ii) attended at least one educational meeting, presentation or 34 conference sponsored by the state-wide professional insurance 35 producer association during such two-year period, and (iii) read all 36 ethical standards applicable to such person in such person's capacity as 37 a licensed insurance producer. 38 This act shall take effect as follows and shall amend the following sections: Section 1 July 1, 2019 38a-782a Statement of Purpose: To specify that if the Insurance Commissioner adopts regulations requiring insurance producers to earn six or more hours of continuing education credit during any two-year period, the commissioner shall grant at least six hours of continuing education credit to each Raised Bill No. 7172 LCO No. 4277 3 of 3 insurance producer who was an active member of a state-wide professional insurance producer association during such period.
