AN ACT AMENDING THE CONVEYANCE OF CERTAIN PARCELS OF
STATE LAND IN THE TOWN OF MANSFIELD.
Be it enacted by the Senate and House of Representatives in General
Assembly convened:
Section 1. Section 3 of special act 89-54 is amended to read as 1
follows (Effective from passage): 2
(a) Notwithstanding any provision of the general statutes to the 3
contrary, the [commissioner of mental retardation] Commissioner of 4
Developmental Services shall convey to the town of Mansfield, subject 5
to the approval of the [state properties review board] State Properties 6
Review Board and at a cost equal to the administrative costs of making 7
such conveyance, two parcels of land located in the town of Mansfield, 8
having a total area of approximately 16 acres. The first parcel of land 9
contains approximately 15.6 acres, is a portion of a larger parcel 10
conveyed to the state of Connecticut by William P. Kelley and 11
recorded in the Mansfield Land Records at Volume 47, Page 227 and is 12
the same property shown on a map entitled "Map Showing Land of the 13
State of Connecticut to be Acquired by the Town of Mansfield" dated 14 Raised Bill No. 7418

December 1988, scale 1" - 40 feet, 2 sheets certified A-2 by Grant 15
Meitzler, RLS #10,005, which map is filed in the Mansfield Land 16
Records. Said parcel of land shall be conveyed subsect to an access 17
easement of record in favor of Raymond E. and Marianne Gergler, 18
which is of unspecified width giving a right to pass over said parcel 19
from a point near the top of the hill (at land of Gergler) to Depot Road, 20
the second parcel of land is a triangular parcel of land located westerly 21
of the southwesterly corner of land of Gergler, easterly of the Central 22
Vermont Railroad Company land, and northerly of the northwesterly 23
corner of the first parcel herein described and is the same property 24
shown on a map entitled "Map Showing Land of State of Connecticut 25
to be acquired by the Town of Mansfield", dated January 1989, scale 1" 26
= 20 feet, sheet 2-A of 2, certified Class D by Grant Meitzler, RLS 27
#10,005, which map is to be filed in the Mansfield [land records] Land 28
Records. The conveyance of said parcels of land shall include transfer 29
of rights to the abandoned railroad siding on said parcels to the town 30
of Mansfield, and the right to the use of the existing sewer line, water 31
line, and utility lines located on Connecticut Light and Power 32
Company poles 21, 22, 23 and 24, on terms negotiated by the 33
[commissioner of mental retardation] Commissioner of Developmental 34
Services and the town of Mansfield. The locations of such utility 35
service lines are shown on the above referenced map showing the first 36
parcel of land herein described. 37
(b) The town of Mansfield shall use said parcels of land [for a day 38
care facility] and shall compensate the state of Connecticut for [such 39
facility's] use of the utilities and services of the Mansfield Training 40
School. [If said parcels are not used for such purpose, the parcels shall 41
revert to the state of Connecticut.] 42
(c) The [state properties review board] State Properties Review 43
Board shall complete its review of the conveyance of said parcels of 44
land not later than thirty days after it receives a proposed agreement 45
from the [commissioner of mental retardation] Commissioner of 46
Developmental Services. The land shall remain under the care and 47
control of said commissioner until a conveyance is made in accordance 48 Raised Bill No. 7418

with the provisions of this section. The [state treasurer] State Treasurer 49
shall execute and deliver any deed or instrument necessary for a 50
conveyance under this section and the [commissioner of public works] 51
Commissioner of Administrative Services shall have the sole 52
responsibility for all other incidents of such conveyance. 53
This act shall take effect as follows and shall amend the following
sections:

To amend a prior conveyance of two parcels of state land in the town
of Mansfield.
