LCO No. 4757 1 of 2 General Assembly Committee Bill No. 16 January Session, 2019 LCO No. 4757 Referred to Committee on PUBLIC HEALTH Introduced by: (PH) AN ACT PROHIBITING AN UNAUTHORIZED PELVIC EXAMINATION ON A FEMALE PATIENT WHO IS UNDER DEEP SE DATION OR ANESTHESIA OR UNCONS CIOUS. Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. (NEW) (Effective July 1, 2019) (a) No physician licensed 1 pursuant to chapter 370 of the general statutes, student in a medical 2 school participating in a course of instruction or person participating 3 in a residency program or clinical training program may perform a 4 pelvic examination on a female patient who is (1) under deep sedation 5 or anesthesia, or (2) unconscious unless (A) the patient or, if the patient 6 is incapacitated, the legal representative of the patient gave informed 7 consent to the pelvic examination, (B) the performance of a pelvic 8 examination is within the scope of the surgical procedure or diagnostic 9 examination to be performed on the patient, or (C) in the case of an 10 unconscious patient, the pelvic examination is required for diagnostic 11 purposes. 12 (b) The Department of Public Health (1) shall investigate any 13 alleged violation of subsection (a) of this section pursuant to 14 subdivision (11) of subsection (a) of section 19a-14 of the general 15 Committee Bill No. 16 LCO No. 4757 2 of 2 statutes, and (2) if the department determines a violation was 16 committed, may take disciplinary action under section 19a-17 of the 17 general statutes. 18 This act shall take effect as follows and shall amend the following sections: Section 1 July 1, 2019 New section Statement of Purpose: To prohibit unauthorized pelvic examinations on female patients who have been administered deep sedation or anesthesia or are unconscious.
