AN ACT MAKING CERTAIN PRIVATE OCCUPATIONAL SCHOOLS INELIGIBLE FOR A CERTIFICATE OF AUTHORIZATION AND PUBLIC FUNDS. Be it enacted by the Senate and House of Representatives in General Assembly convened: That part I of chapter 185 of the general statutes be amended to (1) 1 require a private occupational school to disclose to the Office of Higher 2 Education any claims made against such school by a currently or 3 formerly enrolled student if such school requires any student, as a 4 condition of enrollment, to (A) limit participation in a class action 5 lawsuit, (B) limit any claim or damages for such claim, or (C) assert 6 any claim in a less convenient, more costly or more dilatory forum 7 than a judicial forum, and (2) (A) permit said office to deny an 8 application for authorization or reauthorization from such school if it 9 is determined to be in the best interest of the students, and (B) consider 10 such school ineligible to receive any public funds. 11 Statement of Purpose: To prevent private occupational schools that require students to waive certain rights, as a condition of enrollment, from receiving a certificate of authorization or public funds from the Office of Higher Education.
