AN ACT CONCERNING RETROACTI VE MEDICAID ELIGIBILITY FOR 
HOME CARE SERVICES.  
Be it enacted by the Senate and House of Representatives in General 
Assembly convened: 
 
Section 1. Subsection (h) of section 17b-342 of the general statutes is 1 
repealed and the following is substituted in lieu thereof (Effective July 2 
1, 2019): 3 
(h) An individual who is otherwise eligible for services pursuant to 4 
this section shall, as a condition of participation in the program, apply 5 
for medical assistance benefits pursuant to section 17b-260 when 6 
requested to do so by the department and shall accept such benefits if 7 
determined eligible. The Commissioner of Social Services shall provide 8 
payments for Medicaid eligible home care services retroactive to not more 9 
than three months from the date an eligible individual applied for 10 
Medicaid, in accordance with the provisions of 42 CFR 435.915 as applied 11 
to institutional care, provided such applicant has not made a transfer of 12 
assets for less than fair market value for purposes of obtaining or 13 
maintaining Medicaid eligibility in the sixty months before applying. If 14 
the applicant has made such a transfer, the commissioner shall impose a 15 
penalty period in accordance with 42 USC 1396p(c)(1)(D)(ii), as amended 16  Raised Bill No. 566

from time to time. 17 
This act shall take effect as follows and shall amend the following 
sections:
