LCO No. 4093 1 of 2 General Assembly Committee Bill No. 678 January Session, 2019 LCO No. 4093 Referred to Committee on ENERGY AND TECHNOLOGY Introduced by: (ET) AN ACT CONCERNING MA RKINGS MADE PURSUANT TO CAL L BEFORE YOU DIG REQUI REMENTS. Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. Section 16-351 of the general statutes is repealed and the 1 following is substituted in lieu thereof (Effective October 1, 2019): 2 A public utility receiving notice pursuant to section 16-349 shall 3 inform the person, public agency or public utility proposing to 4 excavate, discharge explosives or demolish of the approximate location 5 of its underground facilities in the area in such manner as will enable 6 such person, public agency or public utility to establish the actual 7 location of the underground facilities, and shall provide such other 8 assistance in establishing the actual location of the underground 9 facilities as the authority may require by regulations adopted pursuant 10 to section 16-357, as amended by this act. Such person, public agency 11 or public utility shall designate the area of the proposed excavation, 12 demolition or discharge of explosives as the authority may prescribe 13 by regulations adopted pursuant to section 16-357, as amended by this 14 act. The public utility receiving notice shall mark the approximate 15 location of its underground facilities in such manner and using such 16 Committee Bill No. 678 LCO No. 4093 2 of 2 methods, including color coding, as the authority may prescribe by 17 regulations adopted pursuant to section 16-357, as amended by this 18 act. The authority shall prescribe by regulations adopted pursuant to 19 section 16-357, as amended by this act, that any designation or mark 20 made pursuant to this section that includes markings on streets, 21 sidewalks or other surfaces shall be made with a material that begins 22 to fade not more than three months after such markings are made. If 23 the actual location of the underground facilities cannot be established, 24 the person, public agency or public utility shall so notify the public 25 utility whose facilities may be affected, which shall provide such 26 further assistance as may be needed to determine the actual location of 27 the underground facilities in advance of the proposed excavation, 28 discharge of explosives or demolition. 29 This act shall take effect as follows and shall amend the following sections: Section 1 October 1, 2019 16-351 Statement of Purpose: To require certain proposed excavation markings to be made with materials that begin to fade three months after such markings are made.
