AN ACT CONCERNING A PILOT PROGRAM FOR HE MP 
PRODUCTION.  
Be it enacted by the Senate and House of Representatives in General 
Assembly convened: 
 
Section 1. (NEW) (Effective from passage) Not later than July 1, 2020, 1 
the Commissioner of Agriculture shall adopt regulations, in 2 
accordance with the provisions of chapter 54 of the general statutes, to 3 
establish an agricultural pilot program for the purpose of growing or 4 
cultivating industrial hemp in accordance with the provisions of 5 
section 7 USC 5940, as amended from time to time. Such pilot program 6 
shall be established for the purpose of studying the growth, cultivation 7 
and marketing of industrial hemp in a manner that ensures that only 8 
such department grows or cultivates such industrial hemp through the 9 
use of sites that are certified by, and registered with, the Department of 10 
Agriculture. In developing the regulations required by this section, the 11 
commissioner shall review and incorporate the provisions of the 12 
Kentucky Department of Agriculture Industrial Hemp Research Pilot 13 
Program 2017 Policy Guide, as the commissioner deems appropriate 14 
and consistent with the provisions of 7 USC 5940, as amended from 15 
time to time. For the purposes of this section, "industrial hemp" means 16 
the plant Cannabis sativa L. and any part of such plant, whether 17 
growing or not, with a delta-9 tetrahydrocannabinol concentration of 18 
not more than 0.3 per cent on a dry weight basis. 19  Substitute Bill No. 893

This act shall take effect as follows and shall amend the following 
sections:
