LCO No. 4813 1 of 4 General Assembly Raised Bill No. 999 January Session, 2019 LCO No. 4813 Referred to Committee on ENVIRONMENT Introduced by: (ENV) AN ACT CONCERNING TH E FEE FOR ADOPTING A DOG, CAT OR OTHER DOMESTIC ANIMA L FROM A MUNICIPAL POUND AND REQUIRING THE LICENSING OF SUCH CATS AND OTHER DOMESTIC ANIMALS. Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. Subsection (c) of section 22-332 of the general statutes is 1 repealed and the following is substituted in lieu thereof (Effective July 2 1, 2019): 3 (c) The town treasurer or other fiscal officer shall pay from the dog 4 fund account the advertising expense incurred under the provisions of 5 this section upon receipt of an itemized statement together with a copy 6 of the advertisement as published. Any person who purchases a dog, 7 cat or other domestic animal as a pet shall pay a fee of [five] fifteen 8 dollars to the municipal animal shelter or dog pound and procure a 9 license and tag for such dog, cat or other domestic animal from the 10 town clerk, in accordance with the provisions of section 22-338, as 11 amended by this act. In addition to the [five-dollar] fifteen-dollar fee, 12 any person who purchases a dog, cat or other domestic animal as a pet 13 Raised Bill No. 999 LCO No. 4813 2 of 4 may be charged the cost the municipality incurred, if any, to spay or 14 neuter and vaccinate the dog, provided such charge shall not exceed 15 one hundred fifty dollars. 16 Sec. 2. Section 22-338 of the general statutes is repealed and the 17 following is substituted in lieu thereof (Effective July 1, 2019): 18 (a) Each owner or keeper of a dog of the age of six months or older, 19 except dogs kept under a kennel license as provided in section 22-342, 20 and each owner of a cat or other domestic animal adopted from a 21 municipal animal shelter or dog pound shall cause such dog, cat or 22 other domestic animal to be licensed in the town clerk's office in the 23 town where such dog, cat or other domestic animal is kept, on or 24 before June thirtieth, annually, or at such time as such dog, cat or other 25 domestic animal becomes six months old, and annually thereafter, on 26 or before June thirtieth. The owner or keeper shall pay to such town 27 clerk for such license the sum of [seven] ten dollars for each such 28 neutered male or spayed female dog, cat or other domestic animal and 29 the sum of [twelve] fifteen dollars for each such unneutered male dog, 30 cat or other domestic animal and each such unspayed female dog, cat 31 or other domestic animal, and [one] two additional [dollar] dollars in 32 each case as the town clerk's fee for issuing a tag and license as 33 provided in section 22-340. [Two] Three dollars from each license fee 34 collected for [a] such neutered or spayed dog, cat or other domestic 35 animal shall be deposited into the animal population control account, 36 established under section 22-380g. If an owner or keeper of [a] such 37 dog, cat or other domestic animal fails to procure a license as required 38 by this section, such owner or keeper shall pay the appropriate license 39 fee specified in this section, the town clerk's fee and a penalty of one 40 dollar for each month or fraction thereof [the] such dog, cat or other 41 domestic animal remains unlicensed. 42 (b) Any owner or keeper applying for a license for [a] such dog, cat 43 or other domestic animal under subsection (a) of this section, except 44 for those owners or keepers possessing a rabies vaccination exemption 45 certificate, or a copy thereof, issued pursuant to section 22-339b, shall 46 Raised Bill No. 999 LCO No. 4813 3 of 4 submit to the town clerk a rabies certificate signed by a licensed 47 veterinarian, or a copy thereof, stating that such dog, cat or other 48 domestic animal has been vaccinated against rabies, the date of the 49 vaccination and the duration of the immunity provided by the vaccine. 50 No license shall be issued unless the certificate indicates that the 51 immunity provided by the vaccine is effective at the time of licensing. 52 (c) Any owner or keeper applying for a license for [a] such dog or 53 cat pursuant to subsection (a) of this section that has been exempted 54 from vaccination against rabies pursuant to section 22-339b shall 55 submit to the town clerk a rabies vaccination exemption certificate 56 issued by the department, or a copy thereof, in lieu of a rabies 57 certificate. 58 (d) This section shall not apply to any dog, cat or other domestic 59 animal which is imported into this state for exhibition purposes and 60 which does not remain in this state for more than thirty days. Any 61 person may import, from another state, any licensed dog, cat or other 62 domestic animal with collar, tag and rabies vaccination certificate, and 63 keep the same in this state for not more than thirty days, without 64 complying with the provisions of this section. 65 Sec. 3. Section 22-380l of the general statutes is repealed and the 66 following is substituted in lieu thereof (Effective July 1, 2019): 67 For each license issued pursuant to section 22-338, as amended by 68 this act, for an unspayed or unneutered dog, cat or other domestic 69 animal the town clerk shall collect a surcharge of [six] eight dollars 70 which shall be deposited by such clerk into the animal population 71 control account established pursuant to section 22-380g. 72 This act shall take effect as follows and shall amend the following sections: Section 1 July 1, 2019 22-332(c) Sec. 2 July 1, 2019 22-338 Sec. 3 July 1, 2019 22-380l Raised Bill No. 999 LCO No. 4813 4 of 4 Statement of Purpose: To increase the fee paid by anyone adopting a dog from a municipal shelter and to require the payment of such fee for anyone adopting a cat or other domestic animal from a municipal shelter and to require the licensing of such cats and other domestic animals.
