LCO No. 2126 1 of 7 General Assembly Raised Bill No. 309 February Session, 2020 LCO No. 2126 Referred to Committee on HIGHER EDUCATION AND EMPLOYMENT ADVANCEMENT Introduced by: (HED) AN ACT CONCERNING TU ITION WAIVERS FOR DEPENDENT CHILDREN OF PERMANEN TLY DISABLED VETERANS AT PUBLIC INSTITUTIONS OF HIGHER EDUCATION. Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. Subsection (d) of section 10a-77 of the general statutes is 1 repealed and the following is substituted in lieu thereof (Effective July 1, 2 2020): 3 (d) Said board of trustees shall waive the payment of tuition at any of 4 the regional community-technical colleges (1) for any dependent child 5 of a person whom the armed forces of the United States has declared to 6 be missing in action or to have been a prisoner of war while serving in 7 such armed forces after January 1, 1960, which child has been accepted 8 for admission to such institution and is a resident of the state at the time 9 such child is accepted for admission to such institution, (2) subject to the 10 provisions of subsection (e) of this section, for any (A) veteran who 11 performed service in time of war, as defined in section 27-103, or (B) 12 person with a qualifying condition, as defined in said section, who has 13 received a discharge other than bad conduct or dishonorable from active 14 Raised Bill No. 309 LCO No. 2126 2 of 7 service in the armed forces and who performed service in time of war, 15 except that for purposes of this subsection, "service in time of war" shall 16 not include time spent in attendance at a military service academy, 17 which veteran or person has been accepted for admission to such 18 institution and is domiciled in this state at the time such veteran or 19 person is accepted for admission to such institution, (3) for any resident 20 of the state sixty-two years of age or older, provided, at the end of the 21 regular registration period, there are enrolled in the course a sufficient 22 number of students other than those residents eligible for waivers 23 pursuant to this subdivision to offer the course in which such resident 24 intends to enroll and there is space available in such course after 25 accommodating all such students, (4) for any student attending the 26 Connecticut State Police Academy who is enrolled in a law enforcement 27 program at said academy offered in coordination with a regional 28 community-technical college which accredits courses taken in such 29 program, (5) for any active member of the Connecticut Army or Air 30 National Guard who (A) has been certified by the Adjutant General or 31 such Adjutant General's designee as a member in good standing of the 32 guard, and (B) is enrolled or accepted for admission to such institution 33 on a full-time or part-time basis in an undergraduate degree-granting 34 program, (6) for any dependent child of a (A) police officer, as defined 35 in section 7-294a, or supernumerary or auxiliary police officer, (B) 36 firefighter, as defined in section 7-323j, or member of a volunteer fire 37 company, (C) municipal employee, or (D) state employee, as defined in 38 section 5-154, killed in the line of duty, (7) for any resident of the state 39 who is a dependent child or surviving spouse of a specified terrorist 40 victim who was a resident of this state, (8) for any dependent child of a 41 resident of the state who was killed in a multivehicle crash at or near the 42 intersection of Routes 44 and 10 and Nod Road in Avon on July 29, 2005, 43 [and] (9) for any resident of the state who is a dependent child or 44 surviving spouse of a person who was killed in action while performing 45 active military duty with the armed forces of the United States on or 46 after September 11, 2001, and who was a resident of this state, and (10) 47 for any resident of the state who is a dependent child or surviving 48 spouse of a veteran who is permanently and totally disabled, as 49 Raised Bill No. 309 LCO No. 2126 3 of 7 determined by the United States Department of Veterans Affairs, for an 50 injury incurred while performing active military duty with the armed 51 forces of the United States and who is a resident of the state, provided 52 any waiver of tuition under this subdivision shall be for tuition in excess 53 of any assistance received by such resident pursuant to the Survivors' 54 and Dependents' Educational Assistance Program of said department. 55 If any person who receives a tuition waiver in accordance with the 56 provisions of this subsection also receives educational reimbursement 57 from an employer, such waiver shall be reduced by the amount of such 58 educational reimbursement. Veterans and persons described in 59 subdivision (2) of this subsection and members of the National Guard 60 described in subdivision (5) of this subsection shall be given the same 61 status as students not receiving tuition waivers in registering for courses 62 at regional community-technical colleges. Notwithstanding the 63 provisions of section 10a-30, as used in this subsection, "domiciled in 64 this state" includes domicile for less than one year. 65 Sec. 2. Subsection (d) of section 10a-99 of the general statutes is 66 repealed and the following is substituted in lieu thereof (Effective July 1, 67 2020): 68 (d) Said board shall waive the payment of tuition fees at the 69 Connecticut State University System (1) for any dependent child of a 70 person whom the armed forces of the United States has declared to be 71 missing in action or to have been a prisoner of war while serving in such 72 armed forces after January 1, 1960, which child has been accepted for 73 admission to such institution and is a resident of the state at the time 74 such child is accepted for admission to such institution, (2) subject to the 75 provisions of subsection (e) of this section, for any (A) veteran who 76 performed service in time of war, as defined in section 27-103, or (B) 77 person with a qualifying condition, as defined in said section, who has 78 received a discharge other than bad conduct or dishonorable from active 79 service in the armed forces and who performed service in time of war, 80 except that for purposes of this subsection, "service in time of war" shall 81 not include time spent in attendance at a military service academy, 82 which veteran or person has been accepted for admission to such 83 Raised Bill No. 309 LCO No. 2126 4 of 7 institution and is domiciled in this state at the time such veteran or 84 person is accepted for admission to such institution, (3) for any resident 85 of the state sixty-two years of age or older who has been accepted for 86 admission to such institution, provided (A) such resident is enrolled in 87 a degree-granting program, or (B) at the end of the regular registration 88 period, there are enrolled in the course a sufficient number of students 89 other than those residents eligible for waivers pursuant to this 90 subdivision to offer the course in which such resident intends to enroll 91 and there is space available in such course after accommodating all such 92 students, (4) for any student attending the Connecticut Police Academy 93 who is enrolled in a law enforcement program at said academy offered 94 in coordination with the university which accredits courses taken in 95 such program, (5) for any active member of the Connecticut Army or 96 Air National Guard who (A) has been certified by the Adjutant General 97 or such Adjutant General's designee as a member in good standing of 98 the guard, and (B) is enrolled or accepted for admission to such 99 institution on a full-time or part-time basis in an undergraduate or 100 graduate degree-granting program, (6) for any dependent child of a (A) 101 police officer, as defined in section 7-294a, or supernumerary or 102 auxiliary police officer, (B) firefighter, as defined in section 7-323j, or 103 member of a volunteer fire company, (C) municipal employee, or (D) 104 state employee, as defined in section 5-154, killed in the line of duty, (7) 105 for any resident of this state who is a dependent child or surviving 106 spouse of a specified terrorist victim who was a resident of the state, (8) 107 for any dependent child of a resident of the state who was killed in a 108 multivehicle crash at or near the intersection of Routes 44 and 10 and 109 Nod Road in Avon on July 29, 2005, [and] (9) for any resident of the state 110 who is a dependent child or surviving spouse of a person who was 111 killed in action while performing active military duty with the armed 112 forces of the United States on or after September 11, 2001, and who was 113 a resident of this state, and (10) for any resident of the state who is a 114 dependent child or surviving spouse of a veteran who is permanently 115 and totally disabled, as determined by the United States Department of 116 Veterans Affairs, for an injury incurred while performing active military 117 duty with the armed forces of the United States and who is a resident of 118 Raised Bill No. 309 LCO No. 2126 5 of 7 the state, provided any waiver of tuition under this subdivision shall be 119 for tuition in excess of any assistance received by such resident pursuant 120 to the Survivors' and Dependents' Educational Assistance Program of 121 said department. If any person who receives a tuition waiver in 122 accordance with the provisions of this subsection also receives 123 educational reimbursement from an employer, such waiver shall be 124 reduced by the amount of such educational reimbursement. Veterans 125 and persons described in subdivision (2) of this subsection and members 126 of the National Guard described in subdivision (5) of this subsection 127 shall be given the same status as students not receiving tuition waivers 128 in registering for courses at Connecticut state universities. 129 Notwithstanding the provisions of section 10a-30, as used in this 130 subsection, "domiciled in this state" includes domicile for less than one 131 year. 132 Sec. 3. Subsection (e) of section 10a-105 of the general statutes is 133 repealed and the following is substituted in lieu thereof (Effective July 1, 134 2020): 135 (e) Said board of trustees shall waive the payment of tuition fees at 136 The University of Connecticut (1) for any dependent child of a person 137 whom the armed forces of the United States has declared to be missing 138 in action or to have been a prisoner of war while serving in such armed 139 forces after January 1, 1960, which child has been accepted for admission 140 to The University of Connecticut and is a resident of the state at the time 141 such child is accepted for admission to said institution, (2) subject to the 142 provisions of subsection (f) of this section, for any (A) veteran who 143 performed service in time of war, as defined in section 27-103, or (B) 144 person with a qualifying condition, as defined in said section, who has 145 received a discharge other than bad conduct or dishonorable from active 146 service in the armed forces and who performed service in time of war, 147 except that for purposes of this subsection, "service in time of war" shall 148 not include time spent in attendance at a military service academy, 149 which veteran or person has been accepted for admission to said 150 institution and is domiciled in this state at the time such veteran or 151 person is accepted for admission to said institution, (3) for any resident 152 Raised Bill No. 309 LCO No. 2126 6 of 7 of the state sixty-two years of age or older who has been accepted for 153 admission to said institution, provided (A) such resident is enrolled in 154 a degree-granting program, or (B) at the end of the regular registration 155 period, there are enrolled in the course a sufficient number of students 156 other than those residents eligible for waivers pursuant to this 157 subdivision to offer the course in which such resident intends to enroll 158 and there is space available in such course after accommodating all such 159 students, (4) for any active member of the Connecticut Army or Air 160 National Guard who (A) has been certified by the Adjutant General or 161 such Adjutant General's designee as a member in good standing of the 162 guard, and (B) is enrolled or accepted for admission to said institution 163 on a full-time or part-time basis in an undergraduate or graduate 164 degree-granting program, (5) for any dependent child of a (A) police 165 officer, as defined in section 7-294a, or supernumerary or auxiliary 166 police officer, (B) firefighter, as defined in section 7-323j, or member of 167 a volunteer fire company, (C) municipal employee, or (D) state 168 employee, as defined in section 5-154, killed in the line of duty, (6) for 169 any resident of the state who is the dependent child or surviving spouse 170 of a specified terrorist victim who was a resident of the state, (7) for any 171 dependent child of a resident of the state who was killed in a 172 multivehicle crash at or near the intersection of Routes 44 and 10 and 173 Nod Road in Avon on July 29, 2005, [and] (8) for any resident of the state 174 who is a dependent child or surviving spouse of a person who was 175 killed in action while performing active military duty with the armed 176 forces of the United States on or after September 11, 2001, and who was 177 a resident of this state, and (9) for any resident of the state who is a 178 dependent child or surviving spouse of a veteran who is permanently 179 and totally disabled, as determined by the United States Department of 180 Veterans Affairs, for an injury incurred while performing active military 181 duty with the armed forces of the United States and who is a resident of 182 the state, provided any waiver of tuition under this subdivision shall be 183 for tuition in excess of any assistance received by such resident pursuant 184 to the Survivors' and Dependents' Educational Assistance Program of 185 said department. If any person who receives a tuition waiver in 186 accordance with the provisions of this subsection also receives 187 Raised Bill No. 309 LCO No. 2126 7 of 7 educational reimbursement from an employer, such waiver shall be 188 reduced by the amount of such educational reimbursement. Veterans 189 and persons described in subdivision (2) of this subsection and members 190 of the National Guard described in subdivision (4) of this subsection 191 shall be given the same status as students not receiving tuition waivers 192 in registering for courses at The University of Connecticut. 193 Notwithstanding the provisions of section 10a-30, as used in this 194 subsection, "domiciled in this state" includes domicile for less than one 195 year. 196 This act shall take effect as follows and shall amend the following sections: Section 1 July 1, 2020 10a-77(d) Sec. 2 July 1, 2020 10a-99(d) Sec. 3 July 1, 2020 10a-105(e) Statement of Purpose: To waive the payment of tuition at public institutions of higher education for the dependent children of veterans who are permanently and totally disabled and reside in the state.
