LCO No. 1327 1 of 2 General Assembly Raised Bill No. 5306 January Session, 2021 LCO No. 1327 Referred to Committee on GENERAL LAW Introduced by: (GL) AN ACT ALLOWING CERT AIN PERMITTEES TO SELL ALCOHOLIC LIQUOR FOR OFF-PREMISES CONSUMPTION. Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. (NEW) (Effective from passage) (a) From the effective date of 1 this section until three years after the effective date of this section, the 2 holder of a permit issued pursuant to sections 30-16, 30-21, and 30-22 of 3 the general statutes or subsections (a), (g) (h) or (i) of section 30-22a of 4 the general statutes may sell for consumption off-premise sealed 5 containers of all such alcoholic liquor such permit holder is allowed to 6 sell for on-premise consumption, subject to the requirements of this 7 section and consistent with all local ordinances for the town in which 8 the premise is located. 9 (b) Any alcoholic liquor sold for off-premise consumption pursuant 10 to this section shall be accompanied by food prepared on the permit 11 premises for off-premise consumption. 12 (c) Alcoholic liquor sold for off-premise consumption pursuant to this 13 section may be sold in a container other than the manufacturer's original 14 sealed container. All such alcoholic liquor sold for off-premise 15 Raised Bill No. 5306 LCO No. 1327 2 of 2 consumption shall be given to a consumer in a securely sealed container 16 that prevents consumption without the removal of a tamper-evident lid, 17 cap or seal. A securely sealed container does not include a container 18 with a lid with sipping holes or openings for straws. Each securely 19 sealed container shall be placed in a bag by the permittee's agent or 20 employee prior to removal from the premises. 21 (d) If a permittee is delivering alcoholic liquor and food, such 22 delivery shall be made only by a direct employee of the permittee and 23 not by a third-party vendor or entity, unless such third-party vendor or 24 entity holds an in-state transporters permit. 25 (e) The sale of alcoholic liquor for off-premise consumption pursuant 26 to this section shall be conducted only during the hours a package store 27 is permitted to sell alcoholic liquor under the provisions of subsection 28 (d) of section 30-91 of the general statutes. 29 (f) A sealed container of alcoholic liquor sold pursuant to this section 30 shall not be deemed an open container, provided the sealed container is 31 unopened, the seal has not been tampered with, and the contents of the 32 sealed container have not been partially removed. 33 This act shall take effect as follows and shall amend the following sections: Section 1 from passage New section Statement of Purpose: To allow certain permittees to sell alcoholic liquor for off-premises consumption.
