AN ACT CONCERNING VA CANCIES IN CONSTITUTIONAL
EXECUTIVE BRANCH OFF ICES.
Be it enacted by the Senate and House of Representatives in General
Assembly convened:
Section 1. Section 9-213 of the general statutes is repealed and the 1
following is substituted in lieu thereof (Effective October 1, 2021): 2
[(a)] If the office of Secretary of the State, [or] Comptroller, Attorney 3
General or Treasurer becomes vacant, the General Assembly, if in 4
session, shall fill [it] such office; but, if the vacancy occurs when the 5
General Assembly is not in session or if the General Assembly fails to 6
make an appointment to fill the vacancy, [it shall be filled by] the 7
Governor shall appoint a person to serve as acting Secretary of the State, 8
Comptroller, Attorney General or Treasurer, as applicable, until the next 9
regular session of the General Assembly at which time the Governor 10
shall nominate a successor for such office who shall be subject to 11
approval by the General Assembly. 12
[(b) Any vacancy in the office of Attorney General shall be filled by 13
appointment by the Governor for the unexpired portion of the term. 14

(c) (1) If the office of the Treasurer becomes vacant, the General 15
Assembly, if in session, shall fill the vacancy for the unexpired portion 16
of the term. (2) If the vacancy occurs when the General Assembly is not 17
in session, or if the General Assembly fails to make an appointment to 18
fill the vacancy and the vacancy does not occur in the year in which a 19
state election is to be held for the office of the Treasurer, the Governor 20
shall appoint a person to serve as acting Treasurer until the next regular 21
session of the General Assembly at which time the Governor shall 22
nominate a successor for the office of Treasurer who shall be subject to 23
approval by the General Assembly. (3) If the vacancy occurs when the 24
General Assembly is not in session or if the General Assembly fails to 25
make an appointment to fill the vacancy and the vacancy occurs in the 26
year in which a state election is to be held for the office of the Treasurer, 27
the Deputy Treasurer shall fill the vacancy for the unexpired portion of 28
the term.] 29
This act shall take effect as follows and shall amend the following
sections:
Section 1 October 1, 2021 9-213
Statement of Purpose:
To align for all constitutional executive branch offices the manner in
which any vacancy therein is filled.
