AN ACT CONCERNING MUNICIPAL PERMITTING AND DELINQUENT
TAXES.
Be it enacted by the Senate and House of Representatives in General
Assembly convened:
That the general statutes be amended to permit any municipality, by 1
ordinance, to withhold the issuance of a building permit, zoning permit 2
or certificate of occupancy to (1) any applicant or owner of real property, 3
or (2) any entity in which such applicant or owner had an ownership 4
interest during the seven-year period preceding the date of application 5
for such permit or certificate, if such applicant, owner or entity is 6
delinquent on or not current with respect to a payment plan concerning 7
taxes owed to the municipality, including, but not limited to, motor 8
vehicle taxes, real estate taxes or personal property taxes. These 9
provisions shall not apply to any debt or delinquency lawfully 10
discharged in any bankruptcy proceeding. 11
Statement of Purpose:
To expand municipal discretion to condition the issuance of certain
permits on payment of delinquent taxes.
