AN ACT CONCERNING TH E ONLINE SALE AND DELIVERY OF 
ELECTRONIC NICOTINE DELIVERY SYSTEMS AND VAPOR 
PRODUCTS. 
Be it enacted by the Senate and House of Representatives in General 
Assembly convened: 
 
Section 1. Section 21a-418 of the general statutes is repealed and the 1 
following is substituted in lieu thereof (Effective July 1, 2021): 2 
(a) As used in this section: 3 
(1) "Person" means any individual, firm, fiduciary, partnership, 4 
corporation, limited liability company, trust or association, however 5 
formed; 6 
(2) "Electronic nicotine delivery system" has the same meaning as 7 
provided in section 21a-415; and 8 
(3) "Vapor product" has the same meaning as provided in section 21a-9 
415. 10 
(b) A person with an electronic nicotine delivery system certificate of 11 
dealer registration, when selling and shipping an electronic nicotine 12  Raised Bill No.  6110

delivery system or a vapor product directly to a consumer in the state, 13 
shall: (1) [Ensure] Require such consumer to provide a copy of such 14 
consumer's valid motor vehicle operator's license or valid identity card, 15 
as described in section 1-1h, at the time of sale; (2) ensure that the name 16 
on such consumer's valid motor vehicle operator's license or valid 17 
identity card is identical to the name on the credit card, charge card, 18 
debit card or other method of payment used to purchase such system or 19 
product at the time of sale; (3) ensure that the shipping labels on all 20 
containers of an electronic nicotine delivery system or vapor product 21 
[shipped directly to a consumer in the state conspicuously states] 22 
conspicuously state the following: "CONTAINS AN ELECTRONIC 23 
NICOTINE DELIVERY SYSTEM OR VAPOR PRODUCT	—24 
SIGNATURE OF A PERSON AGE 21 OR OLDER REQUIRED FOR 25 
DELIVERY"; and [(2)] (4) obtain the signature of a person [age] twenty-26 
one years of age or older at the shipping address prior to delivery, after 27 
requiring the signer to demonstrate that he or she is age twenty-one or 28 
older by providing a valid motor vehicle operator's license or a valid 29 
identity card. [described in section 1-1h.]  30 
This act shall take effect as follows and shall amend the following 
sections: 
 
Section 1 July 1, 2021 21a-418 
 
Statement of Purpose:   
To require online sellers of electronic nicotine delivery systems and 
vapor products to require purchasers of such systems and products to 
(1) provide identification at the time of purchase, and (2) ensure that the 
name on such identification matches the name on the method of 
payment used to make the purchase.
