AN ACT CONCERNING TI MELY PAYMENTS TO PER SONAL CARE 
ATTENDANTS. 
Be it enacted by the Senate and House of Representatives in General 
Assembly convened: 
 
Section 1. (NEW) (Effective from passage) (a) As used in this section, (1) 1 
"consumer" and "personal care attendant" have the same meanings as 2 
provided in section 17b-706 of the general statutes, and (2) "timely 3 
payment" means payment on a regular payment date or not later than 4 
forty-eight hours after any issue delaying payment is resolved. A fiscal 5 
intermediary for any of the state-funded programs set forth in section 6 
17b-706 of the general statutes shall provide timely payments to a 7 
personal care attendant employed by a consumer in such state-funded 8 
program. 9 
(b) Such fiscal intermediary shall provide clear and timely 10 
communication to such personal care attendant about payment 11 
discrepancies, payment confirmation or a change in consumer status 12 
that may affect timely payment to the personal care attendant. Such 13 
communication shall include, but not be limited to, (1) sufficient notice 14 
to allow a personal care attendant to address any issue with submitted 15  Raised Bill No.  6560

time records to receive correct payment on the personal care attendant's 16 
regular payment date, (2) a specific and accessible means to address an 17 
issue that may affect payment in sufficient time to receive the correct 18 
payment on the personal care attendant's regular payment date, and (3) 19 
a method for a personal care attendant to receive the correct payment 20 
not later than forty-eight hours after a payment discrepancy has been 21 
resolved. 22 
(c) A fiscal intermediary for a state-funded program that fails to make 23 
timely payments to a personal care attendant in violation of the 24 
provisions of this section shall be subject to a fine of twenty-five dollars 25 
by a state-funded program for each day timely wage payment has been 26 
delayed. 27 
This act shall take effect as follows and shall amend the following 
sections:
