AN ACT CONCERNING CONTRACTS BETWEEN HEALTH CARRIERS AND HEALTH CARE PROVIDERS. Be it enacted by the Senate and House of Representatives in General Assembly convened: That title 38a of the general statutes be amended to provide that no 1 contract entered into or renewed between a health carrier and a health 2 care provider shall contain a provision: (1) Requiring the health care 3 provider to collect from an insured any coinsurance, copayment, 4 deductible or other out-of-pocket expense due and owing for a covered 5 benefit that the health care provider provided to the insured; or (2) 6 permitting the health carrier to reduce any payment to the health care 7 provider due to an insured's nonpayment or partial payment of any 8 coinsurance, copayment, deductible or other out-of-pocket expense due 9 and owing for a covered benefit that the health care provider provided 10 to the insured. 11 Statement of Purpose: To prohibit a health carrier from: (1) Requiring a contracting health care provider to collect any cost-sharing payment due and owing from an insured for a covered benefit that the health care provider provided to the insured; and (2) reducing any payment to a contracting health care Proposed Bill No. 33 LCO No. 98 2 of 2 provider due to an insured's nonpayment or partial payment of the insured's cost-sharing liability for a covered benefit that the health care provider provided to the insured.
