AN ACT AUTHORIZING BOARDS OF EDUCATION TO PAY 
TUITION TO ANOTHER BOARD OF EDUCATION FOR THE 
PURPOSE OF ENROLLING ITS ELEMENTARY SCHOOL 
STUDENTS IN SUCH OTHER SCHOOL DISTRICT.  
 
SUMMARY 
This bill allows local boards of education to “tuition out” students in 
kindergarten through grade 8 to schools in other school districts in lieu 
of operating their own elementary schools. Current law, unchanged by 
the bill, allows boards to do this for grades 9-12 in lieu of operating 
their own high school.  
Under the bill, local boards of education that do not maintain K-8 
schools, or any combination of those grades, must designate a school 
in another district, with State Board of Education approval, that any 
child under its jurisdiction may attend. The local board must pay 
tuition to the local or regional board of education for the child 
attending school in the other district. Existing law, unchanged by the 
bill, applies these same requirements to boards of education that do 
not operate a public high school and choose to tuition out their 
students. 
The bill also makes technical and conforming changes.
