AN ACT ESTABLISHING A STATE -WIDE STROKE REGISTRY.
Be it enacted by the Senate and House of Representatives in General
Assembly convened:
Section 1. (NEW) (Effective October 1, 2022) (a) The Department of 1
Public Health shall maintain and operate a state-wide stroke registry. 2
Such registry shall use the American Heart Association's stroke care 3
program's data set platform and include information and data on stroke 4
care in the state that align with the stroke consensus metrics developed 5
and approved by the American Heart Association. 6
(b) On and after January 1, 2023, each comprehensive stroke center, 7
thrombectomy-capable stroke center, primary stroke center or acute 8
stroke-ready hospital shall, on a quarterly basis, submit to the 9
Department of Public Health data concerning stroke care that are 10
necessary for including in the state-wide stroke registry, as determined 11
by the Commissioner of Public Health, and that, at a minimum, align 12
with the stroke consensus metrics developed and approved by the 13
American Heart Association. 14
(c) Each comprehensive stroke center, thrombectomy-capable stroke 15 Raised Bill No. 5273

center, primary stroke center and acute stroke-ready hospital shall 16
provide access to its records to the Department of Public Health, as the 17
department deems necessary, to perform case finding or other quality 18
improvement audits to ensure completeness of reporting and data 19
accuracy consistent with the purposes of this section. 20
(d) The Department of Public Health may enter into a contract for the 21
receipt, storage, holding or maintenance of the data or files under its 22
control and management. 23
(e) The Department of Public Health may enter into reciprocal 24
reporting agreements with the appropriate agencies of other states to 25
exchange stroke care data. 26
(f) (1) Failure by a comprehensive stroke center, thrombectomy-27
capable stroke center, primary stroke center or acute stroke-ready 28
hospital to comply with the reporting requirements prescribed in this 29
section may result in the department electing to perform the registry 30
services for such comprehensive stroke center, thrombectomy-capable 31
stroke center, primary stroke center or acute stroke-ready hospital. In 32
such case, the comprehensive stroke center, thrombectomy-capable 33
stroke center, primary stroke center or acute stroke-ready hospital shall 34
reimburse the department for actual expenses incurred in performing 35
such services. 36
(2) Any comprehensive stroke center, thrombectomy-capable stroke 37
center, primary stroke center or acute stroke-ready hospital that fails to 38
comply with the provisions of this section shall be liable for a civil 39
penalty not to exceed five hundred dollars for each failure to disclose a 40
stroke care data, as determined by the commissioner. 41
(3) The reimbursements, expenses and civil penalties set forth in this 42
section shall be assessed only after the Department of Public Health has 43
provided a comprehensive stroke center, thrombectomy-capable stroke 44
center, primary stroke center or acute stroke-ready hospital with written 45
notice of deficiency and such comprehensive stroke center, 46
thrombectomy-capable stroke center, primary stroke center or acute 47 Raised Bill No. 5273

stroke-ready hospital has been afforded not less than fourteen business 48
days after the date of receiving such notice to provide a written response 49
to the department. Such written response shall include any information 50
requested by the department. 51
(g) The Commissioner of Public Health may request that the Attorney 52
General initiate an action to collect any civil penalties assessed pursuant 53
to this section and obtain such orders as necessary to enforce any 54
provision of this section. 55
(h) Not later than January 1, 2023, the Department of Public Health, 56
in consultation with the State of Connecticut Stroke Advisory Council, 57
shall establish a stroke registry data oversight committee. Such 58
committee shall monitor the operations of the state-wide stroke registry, 59
provide advice regarding the oversight of such registry, develop a plan 60
to improve quality of stroke care and address disparities in the 61
provision of such care and develop short and long-term goals for 62
improvement of stroke care in comprehensive stroke centers, 63
thrombectomy-capable stroke centers, primary stroke centers and acute 64
stroke-ready hospitals. 65
(i) The Commissioner of Public Health may adopt regulations, in 66
accordance with the provisions of chapter 54 of the general statutes, to 67
implement the provisions of this section. 68
This act shall take effect as follows and shall amend the following
sections:
