LCO No. 1826 1 of 3 General Assembly Raised Bill No. 5276 February Session, 2022 LCO No. 1826 Referred to Committee on PUBLIC HEALTH Introduced by: (PH) AN ACT CONCERNING THE DISPOSAL OF HOME -GENERATED SHARPS. Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. Section 20-576a of the general statutes is repealed and the 1 following is substituted in lieu thereof (Effective October 1, 2022): 2 [Not later than July 1, 2018, the] The Commissioner of Consumer 3 Protection, with the advice and assistance of the Commission of 4 Pharmacy, shall adopt regulations, in accordance with the provisions of 5 chapter 54, to allow not more than fifty retail locations during the first 6 year and not more than an additional fifty retail locations in each year 7 thereafter, at pharmacies licensed pursuant to chapter 400j, to (1) accept 8 and dispose of unused prescription drugs, and (2) on and after January 9 1, 2024, accept and dispose of home-generated sharps. Such regulations 10 shall: [(1)] (A) Comply with federal law regarding the acceptance and 11 disposal of unused prescription drugs and home-generated sharps at 12 pharmacies, [(2)] (B) establish a tracking and monitoring system and 13 security requirements for such drugs and sharps, and [(3)] (C) specify 14 locations within pharmacies where such drugs and sharps may be 15 Raised Bill No. 5276 LCO No. 1826 2 of 3 accepted and stored. The commissioner, after consulting with the 16 Commissioner of Energy and Environmental Protection, shall establish 17 a process in such regulations to ensure the secure removal and 18 destruction of such unused prescription drugs and home-generated 19 sharps, including, but not limited to, allowing for optional prescription 20 drug disposal agreements with law enforcement authorities. As used in 21 this section, "home-generated sharps" means hypodermic needles, pen 22 needles, intravenous needles, lancets and other devices used by 23 individuals in the home to penetrate the skin for the delivery of 24 medications. 25 Sec. 2. (Effective from passage) (a) As used in this section, "home-26 generated sharps" means hypodermic needles, pen needles, intravenous 27 needles, lancets and other devices used by individuals in the home to 28 penetrate the skin for the delivery of medications. 29 (b) The Commissioner of Consumer Protection, in consultation with 30 the Commissioner of Energy and Environmental Protection, shall 31 develop a plan for the establishment of a mail-back program through 32 which residents of the state may safely dispose of home-generated 33 sharps. Not later than January 1, 2023, the Commissioner of Consumer 34 Protection shall report, in accordance with the provisions of section 11-35 4a of the general statutes, regarding such plan and any 36 recommendations for legislative changes necessary to implement such 37 plan to the joint standing committees of the general assembly having 38 cognizance of matters relating to consumer protection and the 39 environment. 40 This act shall take effect as follows and shall amend the following sections: Section 1 October 1, 2022 20-576a Sec. 2 from passage New section Statement of Purpose: To ensure the safe disposal of home-generated sharps.
