AN ACT SAFEGUARDING THE RIGHTS, HEALTH, FINANCES AND QUALITY OF LIFE OF NURSING HOME RESIDENTS. Be it enacted by the Senate and House of Representatives in General Assembly convened: That titles 17b and 19a of the general statutes be amended to 1 safeguard the rights, health, finances and quality of life of nursing home 2 residents by (1) requiring the Department of Social Services to make 3 eligibility determinations for nursing home residents who have applied 4 for medical assistance not later than forty-five days after the department 5 receives the application, provided such application is complete; (2) 6 requiring the department to notify a nursing home resident, or such 7 resident's authorized representative, in writing, not later than fifteen 8 calendar days after a decision is made on such resident's eligibility; (3) 9 prohibiting a nursing home from taking legal action to secure funds or 10 property from such resident until a Medicaid eligibility determination 11 is made; and (4) increasing penalties for nursing homes that fail to meet 12 minimum staffing levels or misuse state-administered funding intended 13 for staff on other expenses. 14 Proposed Bill No. 6386 LCO No. 2254 2 of 2 Statement of Purpose: To ensure the rights of families in engaging with nursing homes regarding care of loved ones.
