LCO No. 5282 1 of 4 General Assembly Raised Bill No. 1183 January Session, 2023 LCO No. 5282 Referred to Committee on GOVERNMENT ADMINISTRATION AND ELECTIONS Introduced by: (GAE) AN ACT CONCERNING STATE CONSTRUCTION RELATED THRESHOLDS. Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. Subsection (a) of section 4b-51 of the general statutes is 1 repealed and the following is substituted in lieu thereof (Effective July 1, 2 2023): 3 (a) The Commissioner of Administrative Services shall have charge 4 and supervision of the remodeling, alteration, repair or enlargement of 5 any real asset, except any dam, flood or erosion control system, 6 highway, bridge or any mass transit, marine or aviation transportation 7 facility, a facility of the Connecticut Marketing Authority, an asset of the 8 Department of Agriculture program established pursuant to section 26-9 237a, or any building under the supervision and control of the Joint 10 Committee on Legislative Management, involving an expenditure in 11 excess of five hundred thousand dollars, and except that (1) the Judicial 12 Branch may have charge and supervision of the remodeling, alteration, 13 repair, construction or enlargement of any real asset involving an 14 Raised Bill No. 1183 LCO No. 5282 2 of 4 expenditure of not more than two million dollars, (2) each constituent 15 unit of the state system of higher education may have charge and 16 supervision of the remodeling, alteration, repair, construction or 17 enlargement of any real asset involving an expenditure of not more than 18 [two] three million dollars, (3) The University of Connecticut shall have 19 charge and supervision of the remodeling, alteration, repair, 20 construction, or enlargement of any project, as defined in subdivision 21 (16) of section 10a-109c, notwithstanding the amount of the expenditure 22 involved, and (4) the Military Department may have charge and 23 supervision of the remodeling, alteration, repair, construction or 24 enlargement of any real asset involving an expenditure of not more than 25 [two] three million dollars. In any decision to remodel, alter, repair or 26 enlarge any real asset, the commissioner shall consider the capability of 27 the real asset to facilitate recycling programs. 28 Sec. 2. Subsection (a) of section 4b-52 of the general statutes is 29 repealed and the following is substituted in lieu thereof (Effective July 1, 30 2023): 31 (a) (1) No repairs, alterations or additions involving expense to the 32 state of five hundred thousand dollars or less or, in the case of repairs, 33 alterations or additions to a building rented or occupied by the Judicial 34 Branch, [one million two hundred fifty thousand] two million dollars or 35 less or, in the case of repairs, alterations or additions to a building rented 36 or occupied by a constituent unit of the state system of higher education, 37 [two] three million dollars or less, shall be made to any state building or 38 premises occupied by any state officer, department, institution, board, 39 commission or council of the state government and no contract for any 40 construction, repairs, alteration or addition shall be entered into without 41 the prior approval of the Commissioner of Administrative Services, 42 except repairs, alterations or additions to a building under the 43 supervision and control of the Joint Committee on Legislative 44 Management or the Military Department and repairs, alterations or 45 additions to a building under the supervision of The University of 46 Connecticut. Repairs, alterations or additions which are made pursuant 47 to such approval of the Commissioner of Administrative Services shall 48 Raised Bill No. 1183 LCO No. 5282 3 of 4 conform to all guidelines and procedures established by the Department 49 of Administrative Services for agency-administered projects. (2) 50 Notwithstanding the provisions of subdivision (1) of this subsection, 51 repairs, alterations or additions involving expense to the state of five 52 hundred thousand dollars or less may be made to any state building or 53 premises under the supervision of the Office of the Chief Court 54 Administrator or a constituent unit of the state system of higher 55 education, under the terms of section 4b-11, and any contract for any 56 such construction, repairs or alteration may be entered into by the Office 57 of the Chief Court Administrator or a constituent unit of the state system 58 of higher education without the approval of the Commissioner of 59 Administrative Services. 60 Sec. 3. Subdivision (6) of section 4b-55 of the general statutes is 61 repealed and the following is substituted in lieu thereof (Effective July 1, 62 2023): 63 (6) "Project" means any state program requiring consultant services if 64 the cost of such services is estimated to exceed [five hundred] seven 65 hundred fifty thousand dollars, adjusted annually on and after July 1, 66 2024, in accordance with the provisions of section 4 of this act; 67 Sec. 4. (NEW) (Effective July 1, 2023) Not later than July 1, 2024, and 68 annually thereafter, the Commissioner of Administrative Services shall 69 adjust the threshold cost for consultant services for a state program to 70 be deemed a project for the purposes of section 4b-1 of the general 71 statutes and sections 4b-55 to 4b-59, inclusive, of the general statutes, as 72 amended by this act. The commissioner shall adjust such threshold cost 73 by the percentage change in the Producer Price Index by Commodity: 74 Construction (Partial) (WPU80), not seasonally adjusted, or its successor 75 index, as calculated by the United States Department of Labor, over the 76 preceding calendar year, rounded to the nearest multiple of one 77 hundred dollars. 78 This act shall take effect as follows and shall amend the following sections: Raised Bill No. 1183 LCO No. 5282 4 of 4 Section 1 July 1, 2023 4b-51(a) Sec. 2 July 1, 2023 4b-52(a) Sec. 3 July 1, 2023 4b-55(6) Sec. 4 July 1, 2023 New section Statement of Purpose: To permit constituent units of the state system of higher education and the Military Department to have charge and supervision of certain changes to real assets involving expenditures of not more than three million dollars, redefine "project" for purposes of the threshold for consultant services and permit the Commissioner of Administrative Services to adjust such threshold.
