Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. Subsection (b) of section 10a-34g of the general statutes is 1 repealed and the following is substituted in lieu thereof (Effective July 1, 2 2024): 3 (b) The executive director of the Office of Higher Education may deny 4 the application for initial or renewed [license or accreditation] 5 authorization of a for-profit institution of higher education or consider 6 a for-profit institution of higher education ineligible to receive any 7 public funds, including, but not limited to, federal funds administered 8 by the office pursuant to section 10a-45 if (1) such institution fails to 9 include the statement required under subsection (a) of this section in its 10 application, or (2) upon review of such statement, the executive director 11 determines that the public policy of protecting the interests of students 12 in the state requires such denial. Notwithstanding the provisions of 13 Bill No. 303 LCO 2095 {\\PRDFS1\SCOUSERS\FORZANOF\WS\2024SB-00303- R01-SB.docx } 2 of 4 subsection (i) of section 10a-34, the executive director may deny the 14 [accreditation] authorization of an institution of higher education, for 15 the purposes of this subsection, by refusing to accept or withdrawing 16 any previous acceptance of [regional] accreditation made under 17 subsection (i) of said section. 18 Sec. 2. Subsection (b) of section 10a-44d of the 2024 supplement to the 19 general statutes is repealed and the following is substituted in lieu 20 thereof (Effective July 1, 2024): 21 (b) There is established the Connecticut Open Educational Resource 22 Coordinating Council, which shall be part of the Connecticut State 23 Colleges and Universities. The president shall appoint the members of 24 the council, which shall consist of the following: (1) A state-wide 25 coordinator, who shall collaborate with all institutions of higher 26 education to promote open educational resources and administer 27 grants; (2) one faculty member, one administrator and one staff member 28 from The University of Connecticut; (3) one faculty member, one 29 administrator and one staff member from the regional community-30 technical college system; (4) one faculty member, one administrator and 31 one staff member from Charter Oak State College; (5) one faculty 32 member, one administrator and one staff member from the Connecticut 33 State University System; (6) one faculty member, one administrator and 34 one staff member from the independent institutions of higher education; 35 and (7) one student from any public or independent institution of higher 36 education in the state. All initial appointments to the council shall be 37 made not later than September 1, 2019, and shall expire on August 30, 38 2022, regardless of when the initial appointment was made. Any 39 member of the council may serve more than one term. 40 Sec. 3. Subsection (b) of section 10a-178 of the 2024 supplement to the 41 general statutes is repealed and the following is substituted in lieu 42 thereof (Effective July 1, 2024): 43 (b) "Project", in the case of a (1) participating institution for higher 44 education, means a (A) structure suitable for use as a dormitory or other 45 Bill No. 303 LCO 2095 {\\PRDFS1\SCOUSERS\FORZANOF\WS\2024SB-00303- R01-SB.docx } 3 of 4 housing facility, including housing for staff members, employees or 46 students at such institution of higher education, dining hall, student 47 union, administration building, academic building, library, laboratory, 48 research facility, classroom, athletic facility, health care facility, and 49 maintenance, storage or utility facility and other structures or facilities 50 related thereto or required or useful for the instruction of students or 51 the conducting of research or the operation of an institution for higher 52 education, including parking and other facilities or structures essential 53 or convenient for the orderly conduct of such institution for higher 54 education, also including equipment and machinery and other similar 55 items necessary or convenient for the operation of a particular facility or 56 structure in the manner for which its use is intended or for the operation 57 of a participating institution for higher education, or any combination 58 thereof, or (B) program or service that is in furtherance of the 59 organization or mission of a participating institution of higher 60 education; (2) participating health care institution means a (A) structure 61 suitable for use as a hospital, clinic, or other health care facility, 62 laboratory, laundry, residence facility, including housing for nurses, 63 interns, staff members, employees or students at such health care 64 institution and their immediate families and for physically or mentally 65 handicapped persons, administration building, research facility, and 66 maintenance, storage or utility facility and other structures or facilities 67 related thereto or required or useful for the operation of the project, 68 including parking and other facilities or structures essential or 69 convenient for the orderly operation of such project, also including 70 equipment and machinery and other similar items necessary or 71 convenient for the operation of the project in the manner for which its 72 use is intended or for the operation of a participating health care 73 institution, or any combination thereof, or (B) program or service that is 74 in furtherance of the organization or mission of a participating health 75 care institution; (3) participating qualified nonprofit organization means 76 a (A) structure or facility owned in its entirety by, or suitable for use in 77 accordance with the charitable or nonprofit status of the qualified 78 nonprofit organization, also including equipment and machinery and 79 other similar items necessary or convenient for the operation of the 80 Bill No. 303 LCO 2095 {\\PRDFS1\SCOUSERS\FORZANOF\WS\2024SB-00303- R01-SB.docx } 4 of 4 project in the manner for which its use is intended or for the operation 81 of a participating qualified nonprofit corporation, or (B) program or 82 service that is in furtherance of the organization or mission of a 83 participating qualified nonprofit organization; and (4) participating 84 nursing home means a (A) structure or facility suitable for use as a 85 nursing home, residential care home, rest home, health care facility for 86 the handicapped, mental health facility or independent living facility 87 subject to the licensing requirements of chapter 368v and appurtenant 88 facilities, equipment and machinery and other similar items necessary 89 or convenient for the operation of a particular facility or structure in the 90 manner for which its use is intended or for the operation of a 91 participating nursing home, or (B) program or service that is in 92 furtherance of the organization or mission of a participating nursing 93 home; 94 This act shall take effect as follows and shall amend the following sections: Section 1 July 1, 2024 10a-34g(b) Sec. 2 July 1, 2024 10a-44d(b) Sec. 3 July 1, 2024 10a-178(b) HED Joint Favorable
