LCO No. 1763 1 of 2 General Assembly Proposed Bill No. 6066 January Session, 2025 LCO No. 1763 Referred to Committee on GOVERNMENT OVERSIGHT Introduced by: REP. CASE, 63rd Dist. AN ACT REQUIRING A LEGISLATIVE REPORT AND INFORMATIONAL HEARING CONCERNING THE MOST RECENT AUDITORS' REPORT OF THE DEPARTMENT OF DEVELOPMENTAL SERVICES. Be it enacted by the Senate and House of Representatives in General Assembly convened: That (1) the Commissioner of Developmental Services be required to 1 submit a report to the General Assembly outlining the department's 2 efforts to address the findings contained in the report issued by the 3 Auditors of Public Accounts examining the department's operations for 4 the fiscal years ending June 30, 2021, and June 30, 2022, and (2) the joint 5 standing committee of the General Assembly having cognizance of 6 matters relating to government oversight shall hold an informational 7 hearing on the commissioner's report with the goals of identifying (A) 8 what internal controls the department should implement to ensure that 9 -the department promptly performs its mortality reviews and 10 documents the reasons for any delay in such review, (B) what internal 11 controls and monitoring efforts may be implemented by the department 12 to ensure the prompt completion and adequate documentation of abuse 13 and neglect investigations, (C) means by which the department may 14 Proposed Bill No. 6066 LCO No. 1763 2 of 2 better monitor its employees assigned to workers' compensation light 15 duty to ensure that such employees do not earn overtime while working 16 in a limited capacity, (D) a course of action for the department to address 17 any other shortcomings identified in the Auditors' report, and (E) the 18 extent to which the shortcomings identified in the Auditors' report were 19 caused by the negligent acts or omissions of department leadership, staff 20 or contractors. 21 Statement of Purpose: To require (1) the Department of Developmental Services to submit a report concerning the department's efforts to address the finding contained in the most recent report by the Auditors of Public Accounts, and (2) a legislative informational hearing to be held on such report.
