AN ACT ESTABLISHING A CAUSE OF ACTION AGAINST THE STATE FOR INJURY OR ILLNESS CAUSED TO A STUDENT AS A RESULT OF VACCINATION OR MEDICINAL TREATMENT REQUIREMENTS. Be it enacted by the Senate and House of Representatives in General Assembly convened: That the general statutes be amended to allow a student to bring a 1 cause of action in the Superior Court against the State of Connecticut 2 for: (1) Actual damages for injuries or illness caused by a vaccination or 3 medicinal treatment program if the state required students at a school 4 or institution of higher education in this state to receive such vaccination 5 or medicinal treatment program as a condition of school admission; and 6 (2) punitive damages, if the state knowingly requires the vaccination or 7 medicinal treatment without confirming its safety based on publicly 8 available medical testing and documentation. 9 Statement of Purpose: To create a cause of action allowing a student to recover actual and punitive damages for injuries or illness caused by a vaccination or medicinal treatment program if the state required the student to receive the vaccine or medicinal treatment as a condition of school admission.
