AN ACT ELIMINATING INCARCERATION AS A SANCTION FOR A NONCRIMINAL TECHNICAL PROBATION VIOLATION AND CONCERNING OTHER PROBATION SYSTEM REFORMS. Be it enacted by the Senate and House of Representatives in General Assembly convened: That title 54 of the general statutes be amended to (1) eliminate 1 incarceration for noncriminal violations and implement proportionate, 2 noncustodial consequences such as suspension of earned time credit, (2) 3 introduce earned time credit to shorten probation sentences for 4 compliance, (3) guarantee timely hearing, neutral locations and the right 5 to counsel for individuals accused of violations, (4) remove supervision 6 fees and other financial obligations that disproportionately impact low-7 income individuals, and (5) replace automatic detention with written 8 notices for noncriminal violations. 9 Statement of Purpose: To reform the probation system by eliminating incarceration for noncriminal technical violations, introducing earned time credit and removing burdensome supervision fees in order to incentivize success, reduce caseloads and reduce the trauma of arrest.
