AN ACT CONCERNING MEDICAID COVERAGE FOR MEDICALLY 
NECESSARY CHILDREN'S DIAPERS. 
Be it enacted by the Senate and House of Representatives in General 
Assembly convened: 
 
Section 1. (NEW) (Effective July 1, 2025) (a) As used in this section, 1 
"medical necessity" means a determination by a physician or physician 2 
assistant licensed pursuant to chapter 370 of the general statutes or an 3 
advanced practice registered nurse licensed pursuant to chapter 378 of 4 
the general statutes that the provision of diapers to a child is medically 5 
necessary to prevent or ameliorate (1) severe and persistent diaper 6 
dermatitis, urinary tract infection or other disease of the skin related to 7 
inadequate diaper hygiene, or (2) another health condition, including, 8 
but not limited to, a developmental, psychiatric or neurological 9 
condition, that results in an unusual need to void or delayed 10 
developmentally appropriate toileting behavior. 11 
(b) The Commissioner of Social Services shall amend the Medicaid 12 
state plan to extend Medicaid coverage for diapers to children from 13 
birth to age three deemed to have a medical necessity for diapers. Not 14 
later than September 1, 2026, the commissioner shall file a report, in 15

accordance with the provisions of section 11-4a of the general statutes, 16 
with the joint standing committee of the General Assembly having 17 
cognizance of matters relating to human services on the (1) number of 18 
children from birth to age three determined to have a medical necessity 19 
for diapers in the previous fiscal year, (2) cost to the state to provide 20 
Medicaid coverage for diapers for such children, and (3) estimated 21 
savings on state Medicaid costs for treatment of potential health care 22 
conditions averted by the provision of access to diapers covered by 23 
Medicaid. 24 
This act shall take effect as follows and shall amend the following 
sections: 
 
Section 1 July 1, 2025 New section

To provide Medicaid coverage for medically necessary diapers for 
children.
