AN ACT CONCERNING STATE AGENCY INTERPRETATION OF
STATUTES AND THE REGULATIONS AUTHORIZED AND ADOPTED
UNDER SUCH STATUTES.
Be it enacted by the Senate and House of Representatives in General
Assembly convened:
That section 1-2z of the general statutes be amended to specify that a 1
state agency's interpretation of an ambiguous statute, which provides 2
the state agency with the authority to adopt regulations to effectuate the 3
provisions of the statute, shall be given deference provided the agency's 4
interpretation of the statute is reasonable. 5
Statement of Purpose:
To afford proper deference to a state agency's interpretation of an
ambiguous statute provided the agency's interpretation of the statute is
reasonable.
