LCO No. 3607 1 of 2 General Assembly Raised Bill No. 1190 January Session, 2025 LCO No. 3607 Referred to Committee on PUBLIC HEALTH Introduced by: (PH) AN ACT REQUIRING NURSING HOMES AND ASSISTED LIVING FACILITIES TO BE EQUIPPED WITH AN AUTOMATED EXTERNAL DEFIBRILLATOR. Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. (NEW) (Effective October 1, 2025) (a) As used in this section: 1 (1) "Assisted living facility" means a facility operated by an assisted 2 living services agency, as defined in section 19a-490 of the general 3 statutes, that provides chronic and stable individuals with services that 4 include, but need not be limited to, nursing services and assistance with 5 activities of daily living and may have a dementia special care unit or 6 program, as defined in section 19a-562 of the general statutes; 7 (2) "Automated external defibrillator" means a device that: (A) Is used 8 to administer an electric shock through the chest wall to the heart; (B) 9 contains internal decision-making electronics, microcomputers or 10 special software that allows it to interpret physiologic signals, make 11 medical diagnosis and, if necessary, apply therapy; (C) guides the user 12 through the process of using the device by audible or visual prompts; 13 and (D) does not require the user to employ any discretion or judgment 14 Raised Bill No. 1190 LCO No. 3607 2 of 2 in its use; and 15 (3) "Nursing home" means (A) any chronic and convalescent nursing 16 home or any rest home with nursing supervision that provides nursing 17 supervision under a medical director twenty-four hours per day; or (B) 18 any chronic and convalescent nursing home that provides skilled 19 nursing care under medical supervision and direction to carry out 20 nonsurgical treatment and dietary procedures for chronic diseases, 21 convalescent stages, acute diseases or injuries. 22 (b) Not later than January 1, 2026, the administrator of each nursing 23 home and each assisted living facility shall (1) provide and maintain an 24 automated external defibrillator in a central location on the premises of 25 the home or facility, (2) make such central location known and accessible 26 to staff members and residents of the home or facility and family 27 members of such residents who visit the home or facility, (3) ensure that 28 at least one staff member of the home or facility, who is trained in 29 cardiopulmonary resuscitation and the use of an automatic external 30 defibrillator in accordance with the standards set forth by the American 31 Red Cross or American Heart Association, is on the premises of the 32 home or facility during all hours of operation, and (4) maintain and test 33 the automatic external defibrillator in accordance with the 34 manufacturer's guidelines. 35 This act shall take effect as follows and shall amend the following sections: Section 1 October 1, 2025 New section Statement of Purpose: To require nursing homes and assisted living facilities to be equipped with an automated external defibrillator.
