LCO No. 4678 1 of 2 General Assembly Raised Bill No. 1326 January Session, 2025 LCO No. 4678 Referred to Committee on PUBLIC HEALTH Introduced by: (PH) AN ACT CONCERNING THE DEPARTMENT OF PUBLIC HEALTH'S RECOMMENDATIONS REGARDING FOOD SAFETY AND ORAL HEALTH. Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. Section 19a-38 of the general statutes is repealed and the 1 following is substituted in lieu thereof (Effective from passage): 2 A water company, as defined in section 25-32a, shall add a measured 3 amount of fluoride to the water supply of any water system that it owns 4 and operates and that serves twenty thousand or more persons so as to 5 maintain an average monthly fluoride content [that is not more or less 6 than 0.15 of a milligram per liter different than the United States 7 Department of Health and Human Services' most recent 8 recommendation for optimal fluoride levels in drinking water to 9 prevent tooth decay] of 0.7 of a milligram per liter, provided said 10 average monthly fluoride content shall not deviate greater or less than 11 0.15 of a milligram per liter. 12 Sec. 2. Section 19a-36h of the general statutes is repealed and the 13 following is substituted in lieu thereof (Effective from passage): 14 Raised Bill No. 1326 LCO No. 4678 2 of 2 (a) Not later than January 1, 2023, the commissioner shall adopt and 15 administer by reference the United States Food and Drug 16 Administration's Food Code [, as amended from time to time,] and any 17 revision thereto issued on or before December 31, 2024. The 18 commissioner may adopt any Food Code Supplement published by said 19 administration as the state's food code for the purpose of regulating 20 food establishments. 21 (b) The commissioner may adopt regulations, in accordance with the 22 provisions of chapter 54, to implement the provisions of this section and 23 sections 19a-36i to 19a-36m, inclusive. 24 This act shall take effect as follows and shall amend the following sections: Section 1 from passage 19a-38 Sec. 2 from passage 19a-36h Statement of Purpose: To (1) increase the average monthly fluoride content of water systems, and (2) require the Commissioner of Public Health to adopt and administer by reference the United States Food and Drug Administration's Food Code and any revision thereto issued on or before December 31, 2024.
