AN ACT CONCERNING THE EXCLUSION OF PATIENT HEALTH 
INFORMATION AND OPT -IN AND OPT-OUT PROCEDURES 
RELATING TO THE STATE -WIDE HEALTH INFORMATION 
EXCHANGE. 
Be it enacted by the Senate and House of Representatives in General 
Assembly convened: 
 
Section 1. (Effective from passage) The Commissioner of Health 1 
Strategy shall conduct a study to (1) determine whether to exclude 2 
patient health information and medical records relating to certain 3 
sensitive medical procedures, including, but not limited to, plastic 4 
surgery, from the State-wide Health Information Exchange, and (2) 5 
examine current procedures relating to patient participation in the State-6 
wide Health Information Exchange and determine whether to 7 
implement any new opt-in or opt-out procedures for patients. Not later 8 
than February 1, 2026, the commissioner shall submit a report, in 9 
accordance with the provisions of section 11-4a of the general statutes, 10 
concerning the results of such study to the joint standing committee of 11 
the General Assembly having cognizance of matters relating to public 12 
health. 13

This act shall take effect as follows and shall amend the following 
sections:

Statement of Purpose:   
To require the Commissioner of Health Strategy to study (1) whether to 
exclude patient health information and medical records relating to 
certain sensitive medical procedures from the State-wide Health 
Information Exchange, and (2) current procedures relating to patient 
participation in the State-wide Health Information Exchange.
