LCO No. 5757 1 of 3 General Assembly Raised Bill No. 1493 January Session, 2025 LCO No. 5757 Referred to Committee on PUBLIC SAFETY AND SECURITY Introduced by: (PS) AN ACT CONCERNING THE UNIFORM INVESTIGATION OF ACCIDENT REPORT AND CERTAIN REPORTS BY PEACE OFFICERS. Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. (Effective from passage) (a) As used in this section, "Model 1 Minimum Uniform Crash Criteria" means a voluntary guideline 2 developed by the National Highway Traffic Safety Administration that 3 represents a minimum, standardized set of data variables to describe 4 motor vehicle accidents, which may be used to identify traffic safety 5 problems and design countermeasures to improve traffic safety 6 nationally and in each state. 7 (b) The Commissioner of Transportation shall conduct a study of any 8 changes necessary to conform the uniform investigation of accident 9 report prescribed by the commissioner pursuant to section 14-108a of 10 the general statutes to the Model Minimum Uniform Crash Criteria. Not 11 later than July 1, 2026, the commissioner shall submit a report, in 12 accordance with the provisions of section 11-4a of the general statutes, 13 on the results of the study and any recommendations for legislation as 14 a result of such study to the joint standing committees of the General 15 Assembly having cognizance of matters relating to transportation and 16 public safety and security. 17 Raised Bill No. 1493 LCO No. 5757 2 of 3 Sec. 2. Section 7-294pp of the general statutes is repealed and the 18 following is substituted in lieu thereof (Effective October 1, 2025): 19 (a) As used in this section: 20 (1) "Emergency medical condition" means a medical condition, 21 whether physical, behavioral or related to a substance use disorder or 22 mental health disorder, that manifests itself by symptoms of sufficient 23 severity, including severe pain, that in the absence of prompt medical 24 attention could reasonably be expected by a prudent layperson who 25 possesses an average knowledge of health and medicine to result in 26 placing the health of the person in serious jeopardy, serious impairment 27 to body function or serious dysfunction of any body organ or part; 28 (2) "Medically unstable" means any condition, whether physical, 29 behavioral or related to a substance use disorder or mental health 30 disorder, that manifests in an unstable medical or mental health status, 31 which could reasonably be understood by a prudent layperson who 32 possesses an average knowledge of health and medicine to lead to an 33 emergency medical condition; and 34 (3) "Peace officer" has the same meaning as provided in section 53a-35 3. 36 (b) Any person who experiences an emergency medical condition or 37 is medically unstable while in direct audio or visual contact with, or 38 under the custody or control of, a peace officer shall have the right to be 39 provided with emergency medical services. 40 (c) Except as provided in subsection (d) of this section, a peace officer 41 shall immediately request emergency medical services for any person 42 who is under such officer's custody or control or otherwise in direct 43 audio or visual contact with the peace officer when such person: (1) Has 44 communicated to the peace officer that the person is (A) experiencing 45 an emergency medical condition, or (B) medically unstable, or (2) has 46 been observed by the peace officer to be (A) experiencing an emergency 47 Raised Bill No. 1493 LCO No. 5757 3 of 3 medical condition, or (B) medically unstable. 48 (d) A peace officer shall not be required to request emergency 49 medical services when such officer (1) has made a reasonable 50 determination that the person is not (A) experiencing an emergency 51 medical condition, or (B) medically unstable, and (2) knows that such 52 person has been seen by a medical professional within the previous 53 twenty-four hours and was released from such medical professional's 54 care after a determination that such person was not (A) experiencing an 55 emergency medical condition, or (B) medically unstable. 56 (e) For any matter in which a person experiences an emergency 57 medical condition or is medically unstable while in direct audio or 58 visual contact with, or under the custody or control of, a peace officer, 59 the peace officer shall prepare a report describing the matter. Upon 60 request by such person, the peace officer shall provide such person with 61 a copy of the report. 62 This act shall take effect as follows and shall amend the following sections: Section 1 from passage New section Sec. 2 October 1, 2025 7-294pp Statement of Purpose: To require (1) the Commissioner of Transportation to conduct a study of any changes necessary to conform the uniform investigation of accident report to the Model Minimum Uniform Crash Criteria, and (2) a peace officer to prepare a report when such officer requests emergency medical services for a person who experiences an emergency medical condition or is medically unstable while in direct audio or visual contact with, or under the custody or control of, such officer.
