McDuffie 7 8 9 10 11 Councilmember Christina Henderson Councilmember Brooke Pinto 12 13 14 15 16 Councilmember Zachary Parker Councilmember Janeese Lewis George 17 18 19 20 21 Councilmember Matthew Frumin 22 23 24 A BILL 25 __________ 26 27 IN THE COUNCIL OF THE DISTRICT OF COLUMBIA 28 ____________________ 29 30 To amend the Office of Gay, Lesbian, Bisexual, and Transgender Affairs Act of 2006 to 31 establish a fund to support programs that promote the welfare of the lesbian, gay, 32 bisexual, transgender, and questioning (LGBTQ) community; and to amend the District 33 of Columbia Revenue Act of 1937 to direct the Mayor to create LGBTQ Pride motor 34 vehicle identification tags to support said fund. 35 36 BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this 37 act may be cited as the “Pride Plates Amendment Act of 2023”. 38 Sec. 2. The Office of Gay, Lesbian, Bisexual, and Transgender Affairs Act of 2006, 39 effective April 4, 2006 (D.C. Law 15-89; D.C. Official Code § 2-1381 et seq.) is amended by 40 adding a new section 4b to read as follows: 41 2 “Sec. 4b. Office of Lesbian, Gay, Bisexual, Transgender, and Questioning Affairs Fund. 42 “(a) There is established an Office of Lesbian, Gay, Bisexual, Transgender, and 43 Questioning Affairs Fund (“Fund”). 44 “(b) Monies received from grants, donations, and fees received by the Department of 45 Motor Vehicles pursuant to section 2m(b)(1) of the District of Columbia Revenue Act of 1937, 46 effective ___ (Bill 25-___; D.C. Official Code 50-1501.02m), shall be deposited into the Fund. 47 “(c) Money in the Fund shall be used by the Office to support programs that promote the 48 welfare of the lesbian, gay, bisexual, transgender, and questioning community. 49 “(d)(1) The money deposited into the Fund but not expended in a fiscal year shall not 50 revert to the unassigned fund balance of the General Fund of the District of Columbia at the end 51 of a fiscal year, or at any other time. 52 “(2) Subject to authorization in an approved budget and financial plan, any funds 53 appropriated in the Fund shall be continually available without regard to fiscal year limitation. 54 “(e) The Mayor shall report annually to the Council on the revenues and activities of the 55 Fund.”. 56 Sec. 3. Title IV of the District of Columbia Revenue Act of 1937, approved August 17, 57 1937 (50 Stat. 679; D.C. Official Code § 50-1501.01 et seq.) is amended by adding a new section 58 2m to read as follows: 59 “Sec. 2m. Issuance of LGBTQ Pride motor vehicle identification tags. 60 “(a) The Mayor shall design and make available for issue one or more LGBTQ Pride 61 motor vehicle identification tags demonstrating support for the LGBTQ community. 62 3 “(b)(1) A resident ordering an LGBTQ Pride tag shall pay a one-time application fee and 63 a display fee each year thereafter. The application fee shall be $25, and the display fee shall be 64 $20, or such other amount as may be established by the Mayor by rule. 65 “(2) The application fee and annual display fee shall be deposited into the Office 66 of Lesbian, Gay, Bisexual, Transgender, and Questioning Affairs Fund established by section 4b 67 of the Office of Lesbian, Gay, Bisexual, and Transgender Affairs Act of 2006, effective ___ (Bill 68 25-___; D.C. Official Code § 2-1385).”. 69 Sec. 4. Fiscal impact statement. 70 The Council adopts the fiscal impact statement in the committee report as the fiscal 71 impact statement required by section 4a of the General Legislative Procedures Act of 1975, 72 approved October 16, 2006 (120 Stat. 2038; D.C. Official Code § 1-301.47a). 73 Sec. 5. Effective date. 74 This act shall take effect following approval by the Mayor (or in the event of veto by the 75 Mayor, action by the Council to override the veto), a 30-day period of congressional review as 76 provided in section 602(c)(1) of the District of Columbia Home Rule Act, approved December 77 24, 1973 (87 Stat. 813; D.C. Official Code § 1-206.02(c)(1)), and publication in the District of 78 Columbia Register. 79
