To amend, on a temporary basis, the Comprehensive Policing and Justice Reform Amendment 10 
Act of 2022 to clarify when law enforcement officers have authority to engage in a 11 
vehicular pursuit of a suspect motor vehicle. 12 
 BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, 13 
That this act may be cited as the “Law Enforcement Vehicular Pursuit Clarification Temporary 14 
Amendment Act of 2023”. 15 
 Sec. 2. Section 128(a) of the Comprehensive Policing and Justice Reform 16 
Amendment Act of 2022, effective April 21, 2023 (D.C. Law 24-345; D.C. Official Code § 5-17 
365.02(a)), is amended as follows: 18 
(a) Paragraph (1)(B) is amended as follows: 19 
(1) By striking the phrase “immediate threat” and inserting the phrase “imminent 20 
threat” in its place. 21 
(b) Paragraph (2)(B) is amended to read as follows: 22 
 “(B) Under the totality of the circumstances, not likely to cause death or 23 
serious bodily injury to any person, other than to the fleeing suspect or suspects.”. 24

(1) Subparagraph (A) is amended by striking the phrase “fleeing suspect,” and 26 
inserting the phrase “fleeing suspect or suspects,” in its place. 27 
(2) Subparagraph (B) is amended to read as follows 28 
“(B) Under the totality of the circumstances, not likely to cause death or 29 
serious bodily injury to any person, other than to the fleeing suspect or suspects; and”. 30 
 Sec. 3. Fiscal impact statement. 31 
The Council adopts the fiscal impact statement of the Budget Director as the fiscal impact 32 
statement required by section 4a of the General Legislative Procedures Act of 1975, approved 33 
October 16, 2006 (120 Stat. 2038; D.C. Official Code § 1-301.47a). 34 
Sec. 4. Effective date.  35 
(a) This act shall take effect following approval by the Mayor (or in the event of veto by 36 
the Mayor, action by the Council to override the veto), a 30-day period of Congressional review 37 
as provided in section 602(c)(1) of the District of Columbia Home Rule Act, approved December 38 
24, 1973 (87 Stat. 813; D.C. Official Code § 1-206.02(c)(1)), and publication in the District of 39 
Columbia Register. 40 
(b) This act shall expire after 225 days of its having taken effect. 41
