White, Jr. 2 3 4 5 6 7 A BILL 8 ________ 9 10 IN THE COUNCIL OF THE DISTRICT OF COLUMBIA 11 _______________ 12 13 To amend the Rental Housing Act of 1985, on an emergency basis, to give housing providers until 14 January 1, 2024, to comply with a legislative change that requires a 60-day notice of a rent 15 increase to tenants. 16 17 BE IT ENACTED BY THE COUNCIL DISTRICT OF COLUMBIA, That this act may 18 be cited as the “Fairness in Renting Notice Clarification Emergency Amendment Act of 2023”. 19 Sec. 2. Section 904(b) of the Rental Housing Act of 1985, effective July 17, 1985 (D.C. 20 Law 6-10; D.C. Official Code § 42-3509.04(b)), is amended by striking the word “tenant” and 21 inserting the phrase “tenant, or, if the notice was provided before January 1, 2024, more than 30 22 days after the notice of the increase is given to the tenant”. 23 Sec. 3. Applicability date. 24 This act shall apply as of November 28, 2023. 25 Sec. 4. Fiscal impact statement. 26 The Council adopts the fiscal impact statement of the Budget Director as the fiscal impact 27 statement required by section 4a of the General Legislative Procedures Act of 1975, approved 28 October 16, 2006 (120 Stat. 2038; D.C. Official Code § 1- 301.47a). 29 Sec. 5. Effective date. 30 This act shall take effect following approval by the Mayor (or in the event of veto by the 31 Mayor, action by the Council to override the veto), and shall remain in effect for no longer than 32 2 90 days, as provided for emergency acts of the Council of the District of Columbia in section 33 412(a) of the District of Columbia Home Rule Act, approved December 24, 1973 (87 Stat. 788; 34 D.C. Official Code § 1- 204.12(a)). 35
