IN THE COUNCIL OF THE DISTRICT OF COLUMBIA 
17 To approve, on an emergency basis, Contract No. CW77783 with Lamont Homes, Inc	., and 
18 Modification Nos. 9, 	10, 11, and 12 to Contract No. CW77783, and to authorize payment 
19 for the goods and services received and 	to be received under the contract and 
20 modifications.

22 BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this 
23 act may be cited as the "Contract No. CW77783 with Lamont Home	s, Inc. Approval and 
24 Payment Authorization Emergency Act 
of 2024". 
25 Sec. 2. Pursuant to section 451 of the District of Columbia Home Rule Act, approved 
26 December 24, 
1973 (87 Stat. 803; D.C. Official Code§ 1-204.51), and consistent with the 
27 requirements 
of section 202 of the Procurement Practices Reform Act 	of 2010, effective April 8, 
28 2011 (D. C. Law 18-371; D.C. Official Code§ 2-352.02), the Council approves Contract No. 
29 CW77783 with Lamont Homes, Inc. and Modification Nos. 9, 
10, 11, and 12 thereto, and 
30 authorizes payment in the not-to-exceed contract amount 
of $1,225,990.20 for the goods and 
31 services received and to be received under the contract and modifications. 
32 Sec. 3. Fiscal impact statement.   	2 
The Council adopts the fiscal impact statement provided by the Chief Financial Officer as 33 
the fiscal impact statement required by section 4a of the General Legislative Procedures Act of 34 
1975, approved October 16, 2006 (120 Stat. 2038; D.C. Official Code § 1-	301.47a). 35 
Sec. 4.  Effective date. 36 
This act shall take effect following approval by the Mayor (or in the event of veto by the 37 
Mayor, action by the Council to override the veto), and shall remain in effect for no longer than 38 
90 days, as provided for emergency acts of the Council of the District of Columbia in section 39 
412(a) of the District of Columbia Home Rule Act, approved December 24, 1973 (87 Stat. 788; 40 
D.C. Official Code § 1-	204.12(a)). 41  1

 Type of Contract:  	Human Care Agreement under which task orders 
(contract) are to be issued for District requirements. 
  
 Source Selection Method: 	Request for Qualification 
 
(B) For a contract containing option periods, the contract amount for the base period and for each 
option period. If the contract amount for one or more of the option periods differs from the 
amount for the base period, provide an explanation of the reason for the difference: 
 
 Base Period Amount: NTE $950,000 
 (December 6, 2019 through November 30	, 2020) 
 
The difference between the base and option year not to exceed amount is based on anticipated 
annual utilization and the recent increase to the District established unit rate in Fiscal Year 2024. 
 
Option Period One Amount: NTE $950,000 
(December 1, 2020 through November 30, 2021) 
  
        Option Period Two Amount: NTE $839,988.81 
(December 1, 2021 through November 30, 2022) 
 
        Option Period Three Amount: NTE $970,000         (December 1, 2022 through November 30, 2023) 
 
        Option Period Four Amount: $1,225,990.20 NTE  
 
(C) The goods or services to be provided, the methods of delivering goods or services, and any 
significant program changes reflected in the proposed contract:  
 
Lamont Homes, Inc. shall provide supported 	residence services to consumers enrolled in the District’s 
public mental health system, who are diagnosed with a serious mental illness and in need of intensive 
behavioral and medical supports within a structured and supervised setting. 
 
(D) The selection process, including the number of offerors, the evaluation criteria, and the 
evaluation results, including price, technical or quality, and past performance components: 
 
The contracting officer issued a request for qualification (DOC391675)  on April 18, 2018, and  
received 23 responses to the initial solicitation by the due date. All source selection activities were 
conducted prior to the award of the base year of the human care agreement. The evaluation criteria 
consisted of technical evaluation factors and organizational requirements. After evaluation of 
Lamont Homes, Inc.’s response package, the District deemed the provider as being qualified to 
receive a human care agreement to perform supported residence services and that the proposed prices 
which are established prices in Title 22A, Chapter 57 of DCMR, were fair and reasonable.  
 
 
(E) A description of any bid protest related to the award of the contract, including whether the 
protest was resolved through litigation, withdrawal of the protest by the protestor, or 
voluntary corrective action by the District. Include the identity of the protestor, the grounds 
alleged in the protest, and any deficiencies identified by the District as a result of the protest:   
 
None. 
 
(F) The background and qualifications of the proposed provider, including its o	rganization, 
financial stability, personnel, and performance on past or current government or private 
sector contracts with requirements similar to those of the proposed contract: 
 
Lamont Homes, Inc. is an experienced provider with decades of experience providing supported 
residence services and has the necessary organizational structure, experience, technical skills, and 
operational controls to perform the requirements of the human care agreement. Lamont Homes, Inc. 
has demonstrated knowledge and experience working with the consumer population to support 
successful outcomes for DBH consumers. Furthermore, DBH has confirmed the provider has 
maintained a supported residence community residential facility certification in good standing.  
 
(G) The period of performance associated with the proposed change, including date as of which 
the proposed change is to be made effective:  
 
 The period of performance associated with the proposed change is:    Modification M0009 partially exercised option period four from December 1, 2023 through 
February 28, 2024 
 Modification M0010 extended option period four through July 31, 2024 
 Modification M0011 extended option period four through September 30, 2024 
 The period of performance for the proposed modification M0012 is October 1, 2024 through 
November 30, 2024 
 
(H) The value of any work or services performed pursuant to a proposed change for which the 
Council has not provided approval, disaggregated by each proposed change if more than one 
proposed change has been aggregated for Council review:  
 
Option year four is currently partially exercised and below are the modifications. 
Modification No. M0009:  NTE $252,981.90 
 Modification No. M	0010:  Increased funding by $560,995.30 
 Modification No. M0011: Increased funding by $136,022.90 
 Proposed Modification 	No. M0012: Exercises the remainder of option year four and adds 
$275,990.10. 
 
(I) The aggregate dollar value of the proposed changes as compared with the amount of the 
human care agreement as awarded: 
 
 Aggregate Dollar Value: $1,225,990.20
.   
 
(J) The date on which the contracting officer was notified of the proposed change:  
 
In November 2023, the contracting officer was notified by the contract administrator that the 
District was finalizing an increase to the established unit rate for this service in fiscal year 2024, 
which will result in the NTE amount exceeding a million dollars for option year four.  
 
(K) The reason why the proposed change was sent to Council for approval after it is intended to 
take effect:  
 
The contracting officer was notified by DBH that 	the increased rate by the District established unit 
rate for this service in fiscal year 2024, will result in the NTE amount exceeding a 	million dollars 
for option year four.  Therefore, the contracting officer determined it was in the best interest of the 
District to partially exercise option year four to allow for sufficient time to obtain Council approval. 
 
(L) The reason for the proposed change: 
 
The contracting officer was notified by the contract administrator that the District was finalizing an 
increase to the established unit rate for this service in fiscal year 2024, which will result in the NTE 
amount exceeding a million dollars for option year four.  
 
(M) The legal, regulatory, or contractual authority for the proposed change:  
 
 The proposed change is in accordance with 27 DCMR 200	8, Exercise of Options   
(N) A summary of the subcontracting plan required under section 2346 of the Small, Local, and 
Disadvantaged Business Enterprise Development and Assistance Act of 2005, as amended, 
D.C. Official Code § 2-	218.01 et seq. (“Act”), including a certification that the subcontracting 
plan meets the minimum requirements of the Act and the dollar volume of the portion of the 
human care agreement to be subcontracted, expressed both in total dollars and as a percentage 
of the total human care agreement amount:  
 
 A waiver (WR-4826) of the 35% subcontracting requirement was approved by DSLBD on 
September 26, 2023.  
 
(O) Performance standards and the expected outcome of the proposed human care agreement	: 
 
Lamont Homes, Inc. shall provide supported residence services as a DBH certified provider as 
described in Section C of the human care agreement	.  The expected outcome of the human care 
agreement is an improved mental health and quality of life for DBH consumers in the District 
receiving the supported residence services.  
 
  
(P) The amount and date of any expenditure of funds by the District pursuant to the contract prior 
to its submission to the Council for approval:  
 
$252,981.90, November 30, 2023. 
 $560,995.30, February 28, 2024. 
 $136,022.90, May 20, 2024. 
 
  
  
(Q) A certification that the proposed human care agreement is within the appropriated budget 
authority for the agency for the fiscal year and is consistent with the financial plan and budget 
adopted in accordance with D.C. Official Code §§ 47-	392.01 and 47- 392.02:  
 
 The DBH Agency Fiscal Officer has certified that funding in the amount of $1,225,990.20 	is 
available. 
 
(R) A certification that the human care agreement is legally sufficient, including whether the 
proposed provider has any pending legal claims against the District: 
 
 The Office of the Attorney General has determined that the human care agreement is legally 
sufficient, and that the provider has no pending legal claims against the District. 
 
(S) A certification that Citywide Clean Hands database indicates that the proposed provider 	is 
current with its District taxes. If the Citywide Clean Hands Database indicates that the 
proposed provider is not current with its District taxes, either: (1) a certification that the 
provider has worked out and is current with a payment schedule approved by the District; or 
(2) a certification that the provider 	will be current with its District taxes after the District 
recovers any outstanding debt as provided under D.C. Official Code § 2	-353.01(b):    
 The Citywide Clean Hands database indicates that the proposed provider 	is current with its District 
taxes as of May 22, 2024.   
 
(T) A certification from the proposed provider 	that it is current with its federal taxes, or has 
worked out and is current with a payment schedule approved by the federal government:  
 
 The provider has self-certified, via Bidder/Offeror certification form, that 	it is current with its federal 
taxes. 
 
(U) The status of the proposed provider 	as a certified local, small, or disadvantaged business 
enterprise as defined in the Small, Local, and Disadvantaged Business Enterprise Development 
and Assistance Act of 2005, as amended, D.C. Official Code § 2-218.01 et seq	.:

(V) Other aspects of the proposed human care agreement that the Chief Procurement Officer
