White , Jr. 1 2 3 4 A PROPOSED RESOLUTION 5 ______ 6 7 8 IN THE COUNCIL OF THE DISTRICT OF COLUMBIA 9 10 _________________ 11 12 To declare the existence of an emergency with respect to the need to approve the proposed 13 procurement regulations submitted by the District of Columbia Housing Authority. 14 15 RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this 16 resolution may be cited as the “District of Columbia Housing Authority Procurement 17 Clarification Amendment Emergency Declaration Resolution of 2023”. 18 Sec. 2. (a). Section 20 of the District of Columbia Housing Authority Act of 1999, 19 effective May 9, 2000 (D.C. Law 13- 105; D.C. Official Code § 6- 219), requires the District of 20 Columbia Housing Authority (“DCHA”) to draft regulations governing procurements and submit 21 those regulations to the Council for review. 22 (b) Section 20 also exempts DCHA from the requirements of the District of Columbia 23 Procurement Practices Act of 1985, effective February 21, 1986 (D.C Law 6- 85; D.C. Official 24 Code § 2- 301.01 et seq .) (“PPA”), a law which has since been replaced by the Procurement 25 Practices Reform Act of 2010, effective April 8, 2011 ((D.C. Law 18-371; D.C. Official Code 2-26 351.01 et seq .) (“PPRA”). 27 (c) Emergency legislation is necessary to clarify ambiguity in the law as to DCHA’s 28 relationship to the PPRA. 29 2 Sec. 3. The Council of the District of Columbia determines that the circumstances 30 enumerated in section 2 constitute emergency circumstances making it necessary that the District 31 of Columbia Housing Authority Procurement Clarification Emergency Amendment Declaration 32 Resolution of 2023 be adopted after a single reading. 33 Sec. 4. This resolution shall take effect immediately. 34
