Under the proposed contract, Phoenix shall provide 10 Type-A electric school buses according to
the United States Environmental Protection Agency Clean School Bus Rebate Program.

1-204.51) and section 202 of the Procurement Practices Reform Act of 2010 (D.C. Official Code
§ 2-352.02), enclosed for consideration and enactment by the Council of the District of Columbia
is the Multi-year "'Contract No. CW104923 with Phoenix Electric Sales, Inc. Emergency
Approval Resolution of 2023,” and accompanying emergency declaration.

IN THE COUNCIL OF THE DISTRICT OF COLUMBIA
RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
resolution may be cited as the “Contract No. CW104923 with Phoenix Electric Sales, Inc.22
Emergency Declaration Resolution of 2023”.23
Sec. 2. (a) The Office of Contracting and Procurement, on behalf of the Office of the24
State Superintendent of Education, proposes to enter into multiyear Contract No. CW10492325
with Phoenix Electric Sales, Inc. to provide 10 electric school buses as part of the Environmental26
Protection Agency’s 2022 Clean School Bus Rebate Program.27
(b) The not-to-exceed price for the term of this multiyear contract with Phoenix28
Electric Sales, Inc. is S3,681,490 for the two-year period of performance.29
(c) Approval is necessary to allow the District to receive the benefit of this vital30
service in a timely manner from Phoenix Electric Sales, Inc.31

enumerated in section 2 constitute emergency circumstances making it necessary that the35
“Contract No. CW104923 with Phoenix Electric Sales, Inc. Emergency Approval Resolution of36
2023” be adopted after a single reading.37
Sec. 4. This resolution shall take effect immediately.38
