Under the proposed contract, Phoenix shall provide 10 Type-A electric school buses according to
the United States Environmental Protection Agency Clean School Bus Rebate Program.

1-204.51) and section 202 of the Procurement Practices Reform Act of 2010 (D.C. Official Code
§ 2-352.02), enclosed for consideration and enactment by the Council of the District of Columbia
is the Multi-year “Contract No. CW104923 with Phoenix Electric Sales, Inc. Emergency
Approval Resolution of 2023,” and accompanying emergency declaration.

RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
resolution may be cited as the “Contract No. CW104923 with Phoenix Electric Sales, Inc.20
Emergency Approval Resolution of 2023.”21
Sec. 2. (a) The Office of Contracting and Procurement, on behalf of the Office of the22
State Superintendent of Education, proposes to enter into a multiyear contract with Phoenix23

Agency’s 2022 Clean School Bus Rebate Program.25
(b) The not-to-exceed price for the term of this multiyear contract with Phoenix

Electric Sales, Inc. is $3,681,490. The term will be two years from the date of award.27
Sec. 3. Pursuant to section 451(c)(3) of the District of Columbia Home Rule Act,28
approved December 24, 1973 (87 Stat. 803; Pub. L. 93-198; D.C. Official Code § 129
204.51(c)(3)), and section 202 of the Procurement Practices Reform Act of 2010, effective April30
8, 2011 (D.C. Law 18-371; D.C. Official Code § 2-352.02), the Council approves Contract No.31

Officer as the fiscal impact statement required by section 602(c)(3) of the District of Columbia34
Home Rule Act, approved December 24, 1973 (87 Stat. 813; Pub. L. 93-198; D.C. Official Code35
§ 1-206.02(c)(3)).36
Sec. 5. The Secretary to the Council shall transmit a copy of this resolution, upon its37
adoption, to the Mayor.38
Sec. 6. This resolution shall take effect immediately.39
