RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this resolution may be cited as "Modification Nos. 4 and 5 to Contract No. DCAM-20-CS-RFP-0020 with GCS, Inc. Approval and Payment Authorization Emergency Declaration Resolution of 2023". Sec. 2 (a) There exists an immediate need to approve Modification Nos. 4 and 5 to Contract No. DCAM-20-CS-RFP-0020 with GCS, Inc. to provide construction management at risk services associated with the modernization of the Stead Park Recreation Center, and to authorize payment for the services received and to be received under the modifications. 38 (b) On September 13, 2022, via Modification No. 4, the Department of General Services 39 incorporated ADA Impact Costs to Contract No. DCAM-20-CS-RFP-0020, increasing the GMP 40 amount by $700,000.00, from $13,474,000.00 to $14,174,000.00, an amount under $1 million. 41 Therefore, Council approval was not required for this modification. 42 (c) Proposed Modification No. 5 would increase the GMP amount by $329,370.00 from 43 $14,174,000.00 to $14,503,370.00. The aggregate value of the Modification No. 4 and proposed 44 Modification No. 5 is $1,029,370.00, an amount over $1 million; therefore, Council approval of 45 these modifications is required pursuant to section 451 of the District of Columbia Home Rule 46 Act, approved December 24, 1973 (87 Stat. 803; D.C. Official Code§ 1-204.51). 47 48 Sec. 3. The Council of the District of Columbia determines that the circumstances 49 enumerated in section 2 constitute emergency circumstances making it necessary that the 50 "Modification Nos. 4 and 5 to Contract No. DCAM-20-CS-RFP-0020 with GCS, Inc. Approval 51 and Payment Authorization Emergency Act of 2023" be adopted after a single reading. 52 Sec. 4. This resolution shall take effect immediately.
