16 To declare the existence of an emergency with respect to the need to approve Modification No. 3
17 to Contract No. DCAM-20-CS-RFQ-000lAG with RBK Construction, Inc. to provide on-
18 call construction, repair, and replacement services at schools, parks, recreation facilities,
19 municipal buildings, fire and police stations, short-term family housing units, and other
20 public locations, and to authorize payment for the goods and services received and
to be
21 received under the modification.

23 RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
24 resolution may be cited as the "Modification No. 3 to Contract No. DCAM-20-CS-RFQ-000IAG
25 with RBK Construction, Inc. Approval and Payment Authorization Emergency Declaration
26 Resolution
of 2024."
27 Sec. 2 (a) There exists an immediate need to approve Modification No. 3 to Contract No.
28 DCAM-20-CS-RFQ-000lAG with RBK Construction, Inc. for on-call construction, repair, and
29 replacement services, and
to authorize payment for the goods and services received and to be
30 received under the modification.
31 (b) On February 22, 2024, via Modification No. 2, the Department of General Services
32 partially exercised option year two
of Contract No. DCAM-20-CS-RFQ-000lAG, for the period
33 February 23, 2024 through February 22, 2025, in the not-to-exceed amount of $990,000. 2
(c) Modification No. 3 would fully exercise option year two of Contract No. DCAM-20-34
CS-RFQ-0001AG through February 22, 2025, increasing the not -to-exceed amount by 35
$4,010,000 from $990,000 to $5,000,000. 36
(d) Under section 451(b)(1) of the District of Columbia Home Rule Act, approved 37
December 24, 1973 (87 Stat. 803; D.C. Official Code § 1- 204.51(b)(1)), Council approval is 38
necessary since the modification will increase the value of the contract to more than $1 million 39
during a 12- month period. 40
(e) Approval is necessary to allow the continuation of these vital services. Without this 41
approval, RBK Construction, Inc. cannot be paid for goods and services in excess of $1 million 42
for the period February 23, 2024 through February 22, 2025. 43
Sec. 3. The Council of the District of Columbia determines that the circumstances 44
enumerated in section 2 constitute emergency circumstances making it necessary that the 45
Modification No. 3 to Contract No. DCAM-20-CS-RFQ-0001AG with RBK Construction, Inc. 46
Approval and Payment Authorization Emergency Act of 2024 be adopted after a single reading. 47
Sec. 4. This resolution shall take effect immediately. 48
